In the matter of grant of benefit under Section 36(1)(viia) to the tune of Rs.3 Crore, both the Commissioner, Appeals and the Income Tax Appellate Tribunal have granted benefit of deduction to the respondent, a Cooperative Bank working under the control of State of Madhya Pradesh and the concurrent findings recorded by the learned Appellate Authorities being a finding of fact based on due appreciation of evidence and material that came on record, we find no substantial question of law warranting reconsideration now in the appeal under Section 260A of the Income Tax Act.
