Pr Commissioner Of Income Tax I vs. Rajendrasingh Dharamsingh Rajpal
What did the High Court hold?
The High Court allowed the prayer for withdrawal of the appeal. The Court noted that the present appeal was covered under the circulars issued by the Department. Consequently, the appeal was dismissed as withdrawn. However, the Court explicitly stated that the question of law was left open. This means that while the appeal itself was disposed of without a decision on its merits due to the withdrawal, the underlying legal issue remains undecided and could potentially be raised in future proceedings. No specific findings were made on the substantive merits of the case.
What were the facts?
The appeal was filed by the Principal Commissioner of Income Tax, Indore, under Section 260A of the Income Tax Act, 1961, against an order passed by the Income Tax Appellate Tribunal. The Central Board of Direct Taxes (CBDT) had issued circulars (Circular No. 3/2018, revised on 20/08/2018, and further clarified on 08/08/2019 and 06/09/2019) specifying monetary limits for filing appeals. These circulars also outlined exceptions where appeals could be contested on merits irrespective of the tax effect. The appellant's counsel, citing these circulars, prayed for the withdrawal of the present appeal.
What were the issues?
1. Whether the present appeal is maintainable in light of the monetary limits prescribed by CBDT Circular No. 3/2018 and its subsequent revisions, or if it falls under any of the exceptions allowing contestation on merits. The assessee (implicitly, the respondent in the appeal) did not file any submissions as the appeal was withdrawn. The revenue (appellant) argued that the appeal was covered under the departmental circulars and therefore sought withdrawal. The revenue relied on the provisions of CBDT Circular No. 3/2018 and its subsequent amendments, which allowed for appeals to be contested on merits in specific circumstances, including those involving undisclosed foreign assets, information from law enforcement agencies, or pending prosecution, irrespective of the monetary limit.
