Pr Commmissioner Of Income Tax I vs. Monica Galaxi Pvt Ltd
What did the High Court hold?
The High Court held that the appeals filed by the Revenue were not maintainable. The Court noted that the tax effect in all the appeals, including the one for ITA No. 119/2016 (Rs. 19,120/-) and others ranging up to Rs. 6,24,645/-, did not exceed the monetary limit of Rs. 20,00,000/- prescribed by the CBDT Circular dated 10/12/2015 for filing appeals before the High Court. The Court also observed that the present cases did not fall under the exceptions mentioned in paragraph 8 of the Circular, such as challenges to constitutional validity, illegality of Board's orders, or issues related to undisclosed foreign assets. Consequently, the Court disposed of the appeals in light of the Circular, without delving into the merits of the ITAT's orders. No order as to costs was made.
What were the facts?
The Principal Commissioner of Income Tax-I, Indore, filed multiple appeals before the High Court of Madhya Pradesh, Bench at Indore, against orders passed by the Income Tax Appellate Tribunal. These appeals challenged the Tribunal's decisions for various assessment years concerning assessees Kailash Rijhwani, Gurumukh Rijhwani, Kheraj Rijhwani, Monica Galaxy Pvt. Ltd., and Keshav Rijhwani. The appeals were heard analogously due to the similarity in the controversy. The appellant's primary argument was that the monetary tax effect in these cases was less than Rs. 20.00 lacs, and therefore, in light of a CBDT Circular dated 10/12/2015, no appeal should have been filed by the Department.
What were the issues?
1. Whether the appeals filed by the Revenue are maintainable before the High Court, considering the monetary tax effect involved in each case is less than Rs. 20,00,000/-, as stipulated by the CBDT Circular dated 10/12/2015. Assessee's Contention: The assessee argued that the appeals should not have been filed by the Department because the tax effect in each case did not exceed the monetary limit prescribed by the CBDT Circular dated 10/12/2015, which is Rs. 20,00,000/- for appeals before the High Court. The assessee highlighted that the tax effect in the present cases ranged from NIL to Rs. 6,24,645/-, all falling below the prescribed limit. Revenue's Contention: The Revenue did not explicitly record any contention in the judgment regarding the merits of the case or why the appeals should be entertained despite the low tax effect. The entire argument presented by the appellant (Revenue) was based on the applicability of the CBDT Circular.
