The Commissioner Of Income Tax I vs. M/S Sti Power India Ltd.
What did the High Court hold?
The High Court allowed the prayer for withdrawal of the appeals. The appeals were dismissed as withdrawn. However, the court explicitly stated that the question of law is left open. This implies that while the appeals were disposed of on procedural grounds (withdrawal), the underlying legal issues were not adjudicated upon by the High Court. The reasoning for withdrawal is based on the appellant's request, referencing various circulars that govern the filing and contestation of appeals, but ultimately leading to a procedural dismissal rather than a decision on the merits of the tax dispute.
What were the facts?
The Commissioner of Income Tax (Indore) filed three appeals (Income Tax Appeal Nos. 133, 134, and 136 of 2006) before the High Court of Madhya Pradesh, Bench at Indore, against an order passed by the Income Tax Appellate Tribunal. The appeals were filed under Section 260A of the Income Tax Act, 1961. The judgment discusses various circulars issued by the Central Board of Direct Taxes (CBDT) regarding monetary limits for filing appeals before High Courts and the Supreme Court, and exceptions where appeals should be contested on merits. The learned counsel for the appellant (Commissioner of Income Tax) prayed for the withdrawal of the present appeals.
What were the issues?
1. Whether the appeals, filed by the Commissioner of Income Tax, should be decided on merits despite potential issues with monetary limits for filing appeals, considering the provisions of CBDT Circular No. 3/2018 and its subsequent amendments. Assessee's Contention: The judgment does not record any specific contentions made by the assessee (M/s. STI Power India Ltd.). Revenue's Contention: The learned counsel for the appellant (Commissioner of Income Tax) prayed for the withdrawal of the present appeals, indicating a decision not to pursue the appeals on merits.
