I. T. A. No. 117/09 26/08/14 It is pointed out by Shri Bhamore, learned counsel that the default has been removed. That apart, during the course of hearing of this appeal filed by the revenue under Section 260-A of the Income Tax Act, we find that identical appeal by the department against the same respondent for a different assessment year on the same grounds has already been decided by a Co-ordinate Bench of this Court on 31.01.14 in I. T. A. No. 121/09. In view of the order already passed on 31.01.14, we see no reason to interfere into the matter. The appeal is accordingly dismissed.
