COMMISSIONER OF INCOME TAX DEL vs. ARUN KUMAR & SONS
What did the High Court hold?
The High Court held that the value of land on which an incomplete building exists is to be included within the definition of 'assets' under Section 2(ea) of the Wealth Tax Act, 1957. The Court answered the framed question of law against the assessee and in favour of the Revenue. The reasoning was based on the precedent set by the Supreme Court in Giridhar G. Yadalam vs. Commissioner of Wealth Tax and the High Court's own prior judgment in Commissioner of Wealth Tax vs. Veena Rani, which dealt with an identical question. The ratio decidendi is that land forming the site of a building, even if incomplete, constitutes an asset for wealth tax purposes. Consequently, the appeal filed by the Revenue was allowed.
