What did the High Court hold?

The High Court held that the Respondents rejected the Petitioner's application for condonation of delay without providing any reasons. The Court found that the Respondents had examined the Petitioner's case on merits and rejected the claim, effectively passing an assessment order without giving the Petitioner an opportunity to argue his case, which is contrary to law. The Court reasoned that deciding an application for condonation of delay on merits, without affording a hearing, is an improper exercise of power. Consequently, the impugned order dated August 23, 2021, was set aside, and the delay in filing the return for AY 2018-19 was condoned. The Assessing Officer was directed to consider the matter on merits and pass a reasoned order after giving the Petitioner an opportunity of hearing.

What were the facts?

The petitioner, an NRI based in the UK, received death compensation from Pepsu Road Transport Corporation for his wife's accidental death in FY 2017-18. He was issued a manual Form 16A showing interest of Rs. 75,12,950/- and TDS of Rs. 15,02,590/-, which did not reflect in his Form 26AS. After filing grievances, his Form 26AS was updated on March 11, 2020. Due to the delay in TDS reflection, the petitioner filed an application on March 11, 2020, under Section 119(2)(b) of the Income Tax Act, 1961, seeking condonation of delay in filing his return for Assessment Year 2018-19. The Principal Chief Commissioner of Income Tax rejected this application on August 23, 2021.

What were the issues?

1. Whether the Respondents erred in rejecting the Petitioner's application for condonation of delay in filing the return of income for AY 2018-19, contrary to Section 119(2)(b) of the Income Tax Act, 1961, by failing to appreciate that the delay was caused by the non-reflection of TDS in Form 26AS at the time of the due date for filing the return? Assessee's Contention: The Petitioner argued that the delay in filing the return was solely due to the TDS not reflecting in Form 26AS, and the Respondents rejected the application without appreciating this fact. Furthermore, the Petitioner contended that the Respondents exceeded their jurisdiction by deciding on the merits of the TDS refund claim, rather than just the condonation of delay, and that the Petitioner was not given an opportunity to argue the case on merits. Revenue's Contention: The judgment does not record any specific arguments made by the Revenue. However, the impugned order rejected the Petitioner's application.
