What did the High Court hold?

The High Court dismissed the Revenue's appeal. Firstly, it held that the explanation for the 950-day delay in filing the appeal did not constitute a "sufficient cause" for condonation. Secondly, even if the delay were condoned, the substantive issue regarding the treatment of interest earned prior to the commencement of business had already been decided against the Revenue for the Assessment Year 2004-2005 in ITA No. 801/2015. That earlier decision was based on the Supreme Court's ruling in Indian Oil Panipat Consortium vs. Commissioner of Income Tax (2009) 315 ITR 255, which considered all previous binding Supreme Court judgments on the matter. Consequently, the Court found that no substantial question of law arose for consideration, leading to the dismissal of the appeal. The operative direction was the dismissal of the appeal.

What were the facts?

The Revenue, represented by the Commissioner of Income Tax-XIII, filed an appeal against an order concerning B.S.V. Enterprises. The appeal was significantly delayed by 950 days, and the explanation provided for this delay was not considered a "sufficient cause" by the Court. The core issue revolved around the tax treatment of interest earned by the assessee prior to the commencement of its business, specifically whether it should be classified as capital or revenue in nature. The Revenue had previously faced a similar adverse ruling for Assessment Year 2004-2005 in ITA No. 801/2015.

What were the issues?

1. Whether the explanation for the 950-day delay in filing the appeal constitutes a "sufficient cause" under Section 5 of the Limitation Act, 1963, thereby warranting condonation of delay? (Question of fact) 2. Whether the interest earned by the assessee prior to the date of commencement of its business is to be treated as capital or revenue in nature? (Question of law) Assessee's Contentions: The judgment does not record any specific contentions made by the assessee. The assessee was represented by Mr. Pranjal Srivastava, Advocate. Revenue's Contentions: The Revenue argued that the delay in filing the appeal should be condoned. The primary legal contention was regarding the taxability of pre-commencement business interest. The Revenue relied on the principle that such interest should be treated as revenue. The judgment notes that the question urged by the Revenue had been decided against it for a previous AY.

The revenue’s appeal is delayed by 950 days; the explanation for the delay in re-filing the appeal cannot be termed as “sufficient cause”. Even otherwise, the question urged i.e. the treatment of interest earned by the assessee prior to date of the commencement of its business, - whether it is capital or revenue in nature has been held against the revenue itself for the previous AY 2004-2005 in ITA No. 801/2015. This court notices that the said judgment was based upon application of the rule enunciated by the Supreme Court in Indian Oil Panipat Consortium vs. Commissioner of Income Tax reported in (2009) 315 ITR 255. In Indian Oil (supra) in turn had taken into consideration all previous binding judgments of the Supreme Court on the point. Consequently, no question of law arises; the appeal is therefore

dismissed as well.
