The appeal filed by the assessee before the Income Tax appellant Tribunal was dismissed in default on 13.9.2007. The assessee, thereafter, filed application for restoration which has been allowed by the learned Tribunal vide impugned order 10.10.2008. The Tribunal has recorded the finding that the assessee was prevented by sufficient reasonable cause from appearing when this appeal was called on for hearing on 13.9.2007.
