M/s BALAJEE LOHA PRIVATE LIMITED vs. UNION OF INDIA
What did the High Court hold?
The High Court held that the petition stands disposed of in terms of the order of the Hon'ble Supreme Court in Union of India & Others v. Ashish Agarwal. The Supreme Court had directed that Section 148 notices issued to assessees under the unamended Section 148 of the IT Act, which were the subject matter of writ petitions before various High Courts, shall be deemed to have been issued under Section 148A of the IT Act as substituted by the Finance Act, 2021. These notices were to be construed as show-cause notices in terms of Section 148A(b). The assessing officer was directed to provide information and material relied upon by the Revenue within thirty days, allowing assessees two weeks to reply. The requirement of conducting an enquiry under Section 148A(a) was dispensed with as a one-time measure for notices issued under the unamended Section 148 from 01.04.2021 till the date of the Supreme Court's order. Thereafter, assessing officers were to pass orders under Section 148A(d) and then issue notices under Section 148 as substituted. All defenses available to the assessees, including those under Section 149, and all rights and contentions under the Finance Act, 2021, were preserved. The Supreme Court's order was made applicable PAN INDIA and was to govern pending writ petitions before various High Courts.
What were the facts?
The petitioner, M/s Balajee Loha Private Limited, filed a writ petition before the High Court of Chhattisgarh, Bilaspur. The respondents were various authorities of the Union of India and the Income Tax Department. The petitioner's counsel, Mr. Apurv Goyal, along with the counsel for the respondents, submitted that the matter was squarely covered by the judgment of the Hon'ble Supreme Court in Union of India & Others v. Ashish Agarwal. The Supreme Court's judgment dealt with notices issued under Section 148 of the Income Tax Act, 1961, which were issued under the unamended provisions but were subject to challenge before various High Courts. The High Court of Chhattisgarh, in light of the Supreme Court's decision, disposed of the petition.
What were the issues?
1. Whether Section 148 notices issued under the unamended provisions of Section 148 of the Income Tax Act, 1961, prior to the substitution by the Finance Act, 2021, should be deemed to have been issued under Section 148A of the Act, as substituted by the Finance Act, 2021, and treated as show-cause notices under Section 148A(b)? Assessee's Contention: The judgment does not record specific contentions from the assessee for this particular writ petition. However, the submission that the matter is covered by the Supreme Court judgment implies acceptance of the Supreme Court's findings. Revenue's Contention: The Revenue, through its counsel, submitted that the matter is squarely covered by the judgment of the Hon'ble Supreme Court in Union of India & Others v. Ashish Agarwal, implying that the Revenue sought the application of the Supreme Court's directions to this case.
