What did the High Court hold?

The High Court held that the quantum appeal filed by the revenue against the assessee for the same assessment year (ITA No. 76 of 2016) had already been dismissed by this Court vide order dated 23.12.2016. Consequently, since the quantum addition was not sustained, no ground for the levy of penalty under Section 271(1)(c) was made out. Therefore, both appeals filed by the revenue were dismissed. The ratio decidendi is that if the primary addition giving rise to the penalty is deleted or not sustained, the penalty cannot survive.

What were the facts?

The assessee, M/s Amritsar Improvement Trust, filed its return of income for assessment year 2005-06 declaring a loss. The Assessing Officer (AO) assessed the total income at ₹99,11,57,589/-, disallowing exemption under Section 11(1) by treating the assessee's activities as business. The AO also initiated penalty proceedings under Section 271(1)(c) for furnishing inaccurate particulars of income. A penalty of ₹30,34,89,496/- was imposed. The Commissioner of Income Tax (Appeals) [CIT(A)] deleted the penalty. The Income Tax Appellate Tribunal (ITAT) dismissed the revenue's appeal. The revenue has filed these appeals before the High Court against the ITAT's order.

What were the issues?

1. Whether on the facts and circumstances of the case, the ITAT was right in upholding the decision of the CIT(A) in deleting the penalty under Section 271(1)(c) of the Act, as the assessee had furnished inaccurate particulars of income detected by the AO? 2. Whether on the facts and circumstances of the case, the ITAT was correct in deleting the penalty on the basis of deletion of quantum addition, particularly when the revenue had filed an SLP against the High Court's decision on quantum addition pending before the Apex Court? Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The revenue argued that the assessee furnished inaccurate particulars of income, warranting penalty under Section 271(1)(c). They also contended that the deletion of penalty should not be solely based on the deletion of quantum addition, especially when the revenue's appeal on the quantum addition was pending before the Supreme Court.

Which sections of the Income-tax Act were involved?

Section 11(1),Section 143(3),Section 271(1)(c),Section 260A

11.08.2017, Annexure A.4, the Tribunal dismissed the appeal. Hence the instant appeals by the appellant-revenue. 3.

We have heard learned counsel for the parties. 4.

It is not disputed by the learned counsel for the parties that this Court has already dismissed the quantum appeal in the case of the assessee filed by the revenue being ITA No. 76 of 2016 (The Commissioner of Income Tax (Exemptions), Chandigarh Vs. M/s Amritsar Improvement Trust, Amritsar) vide order dated 23.12.2016. Consequently, no ground for levy of penalty has been made out. As a result, both the appeals are dismissed.
