C I T vs. ATTAR SINGH
What did the High Court hold?
The High Court allowed the appeal and answered the substantial question of law in favour of the revenue. The Court referred to its own decision in ITA No. 209 of 2004 (The Commissioner of Income Tax, Faridabad v. Bir Singh (HUF) Ballabgarh) decided on 27.10.2010. In that case, it was held that 'income from Business or profession' and 'income from other sources' are ascertained based on the system of accountancy followed. If no specific method is adopted, it's treated as a cash system. Interest awarded under Section 34 of the relevant Act partakes the character of compensation and is taxable in the year of receipt under Section 45(5)(b). Under a cash system, interest received on enhanced compensation under Section 28 of the 1894 Act falls for taxation under Section 56 as 'income from other sources' in the year of receipt. Therefore, the interest was taxable in the year of receipt.
What were the facts?
The Revenue (Commissioner of Income Tax, Faridabad) appealed against an order of the Income Tax Appellate Tribunal (ITAT) for the assessment year 1997-98. The assessee, Shri Attar Singh, had received interest on enhanced compensation amounting to Rs. 82,58,720/-. The assessee passed away, and notices under Section 148 were issued to his legal heirs. Some legal heirs filed nil income returns. The Assessing Officer completed the assessment at Rs. 82,58,720/-. The CIT(A) upheld this. The ITAT, however, set aside the lower authorities' orders and directed the Assessing Officer to assess the interest in light of directions from a Special Bench. The Revenue's appeal to the High Court challenges the ITAT's decision regarding the timing of taxation of this interest.
What were the issues?
1. Whether on the facts and circumstances of the case, the Hon'ble ITAT is right in holding that assessment of interest cannot be made until the matter is finally settled by the High Court, in contradiction with the judgment of Hon'ble Jurisdictional High Court of Punjab & Haryana following the judgment of Apex Court in the case of CIT vs. Rama Bai (181 ITR 400) whereby interest on enhanced compensation is to be taxed on accrual basis irrespective of the pendency of appeal in higher courts in respect of enhanced compensation? (Question of law, relying on Section 260A of the Income Tax Act, 1961). Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The ITAT erred in holding that interest assessment is postponed until the matter is finally settled by the High Court. The revenue relies on the jurisdictional High Court's decision in CIT vs. Rama Bai (181 ITR 400), which held that interest on enhanced compensation is taxable on an accrual basis, irrespective of pending appeals. The revenue also refers to ITA No. 175 of 05 and ITA No. 177 of 05 in the cases of CIT, Faridabad Vs. Naresh Kumar and CIT, Faridabad Vs. Dilbagh Singh.
