PR COMMISSIONER OF INCOME TAX JALANDHAR-I JALANDHAR vs. ROHIT TANDON
What did the High Court hold?
The High Court noted that the appeal filed by the revenue concerning the disallowance of deduction under Section 10B for the assessment year 2006-07 had been remanded back to the Assessing Officer (AO) for a fresh decision. In light of this remand of the quantum proceedings, the issue of penalty under Section 271(1)(c) was also remanded back to the AO. The AO is to decide the penalty issue after deciding the claim under Section 10B afresh. Therefore, the appeals filed by the revenue were disposed of accordingly, with the operative direction being a remand of the penalty issue to the AO.
What were the facts?
The revenue (Pr. Commissioner of Income Tax) filed three appeals (ITA No. 258 of 2015, ITA No. 28 of 2016, and ITA No. 45 of 2016) against the orders of the Income Tax Appellate Tribunal (ITAT) which had deleted penalties imposed under Section 271(1)(c) of the Income Tax Act, 1961. The appeals pertain to assessment years 2006-07, 2007-08, and 2008-09, with penalty amounts of ₹12,10,524/-, ₹53,15,885/-, and ₹45,22,088/- respectively. The assessee, Sh. Rohit Tandon, proprietor of M/s Prajna (India) Ltd., had his claim for exemption under Section 10B rejected by the Assessing Officer (AO) for the assessment year 2006-07, leading to penalty proceedings. The penalty was confirmed by the CIT(A) but deleted by the ITAT. The High Court noted that the issue of disallowance of deduction under Section 10B for the assessment year 2006-07 had been remanded back to the AO for fresh decision.
What were the issues?
1. Whether on the facts and circumstances of the case, the Hon'ble ITAT is right in law in allowing the appeal in favour of the assessee and deleting the penalty under Section 271(1)(c) of the Income Tax Act, 1961, without discussing the merits of the case? (Question of law) 2. Whether on the facts and circumstances of the case, the Hon'ble ITAT is right in law in allowing the appeal in favour of the assessee and deleting the penalty under Section 271(1)(c) of the Income Tax Act, 1961, ignoring the fact that the Assessing Officer clearly established the default of the assessee by observing that the assessee had transferred its existing business to the new concern with the sole intention to claim exemption under Section 10B? (Question of mixed law and fact) 3. Whether on the facts and circumstances of the case, the Hon'ble ITAT is right in law in allowing the appeal in favour of the assessee and deleting the penalty under Section 271(1)(c) of the Income Tax Act, 1961, ignoring the fact that the penalty under Section 271(1)(c) has rightly been confirmed by the CIT(A)? (Question of mixed law and fact) Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The revenue argued that the ITAT was wrong in deleting the penalty without discussing the merits and ignoring the AO's finding that the business was transferred to claim exemption under Section 10B. They also contended that the penalty was rightly confirmed by the CIT(A).
