What did the High Court hold?

The High Court held that notices issued under Section 148 of the Income Tax Act, 1961, and dispatched prior to April 1, 2021, were not required to be preceded by a notice under Section 148A. This is because Section 148A was prospectively introduced and came into effect on or after April 1, 2021. Therefore, such notices are governed by the unamended provisions. The Court referred to the Supreme Court's decision in Union of India vs. Ashish Agarwal, which clarified that notices issued under the unamended Section 148 before April 1, 2021, would continue to be governed by the old provisions. However, the Court also noted that the Supreme Court in Ashish Agarwal, as a one-time measure for notices issued on or after April 1, 2021, had directed that such notices be deemed to be show-cause notices under Section 148A and allowed assessees to respond. In the present case, since the notice was issued prior to April 1, 2021, the Court found no justifiable reason to interfere with the impugned notice but granted the petitioner liberty to file a written response, after which the Assessing Officer would proceed with the assessment.

What were the facts?

The petitioner, Veer Oil & General Mills, filed a writ petition challenging a notice dated March 30, 2021, issued under Section 148 of the Income Tax Act, 1961, for assessment year 2013-14. The challenge was based on the ground that the notice was not preceded by the procedure prescribed under Section 148A of the Act, which was introduced by the Finance Act, 2021. The Revenue contended that the notice was dispatched to the petitioner prior to April 1, 2021. The High Court considered the Supreme Court's decision in Union of India vs. Ashish Agarwal.

What were the issues?

1. Whether a notice issued under Section 148 of the Income Tax Act, 1961, prior to April 1, 2021, is required to be preceded by the procedure prescribed under Section 148A of the Act, as introduced by the Finance Act, 2021? Assessee's Contention: The assessee argued that the notice dated March 30, 2021, issued under Section 148, was invalid as it was not preceded by the procedure laid down in Section 148A. The assessee relied on the prospective nature of Section 148A's introduction. Revenue's Contention: The Revenue contended that the notice was dispatched before April 1, 2021, and therefore, the amended provisions of Section 148A were not applicable. They relied on the Supreme Court's decision in Union of India vs. Ashish Agarwal.

Which sections of the Income-tax Act were involved?

Notices under Section 148 of the Act, issued and dispatched prior to 01.04.2021, were not required to be preceded by any notice under Section 148A of the Act because Section 148A was prospectively introduced through the Finance Act, 2021 and was to come into effect on or after 01.04.2021.
