SUNIL NAGPAL vs. INCOME TAX OFFICER AND OTHERS
What did the High Court hold?
The High Court allowed the writ petition, disposing of it in terms of its previous judgments in Jatinder Singh Bhangu vs. Union of India and others (CWP No. 15745-2024, decided on 19.07.2024) and Jasjit Singh vs. Union of India and others (CWP No. 21509-2023, decided on 29.07.2024). In those cases, the Court had allowed similar writ petitions on the same issue, granting liberty to the revenue to follow the prescribed procedure under the Act and proceed accordingly if advised. The reasoning was based on the petitioner's contention that the issuing authority lacked jurisdiction due to the exclusive power vested in the NFAC by the CBDT circular dated 29.03.2022. The operative direction was to dispose of the petition in line with the precedent, implying that the impugned proceedings were quashed, with liberty to the revenue to restart the process if permissible.
What were the facts?
The petitioner, Sunil Nagpal, filed a writ petition challenging an order dated 29.03.2024 issued under Section 148A(b) of the Income Tax Act, 1961, and a notice dated 29.03.2024 issued under Section 148 of the Act, along with consequential proceedings, for Assessment Year 2020-2021. The petitioner contended that the issuing authority lacked jurisdiction due to a CBDT circular dated 29.03.2022, which purportedly grants exclusive power to the National Faceless Assessment Centre (NFAC) to issue such notices. The revenue, represented by the Standing Counsel, did not dispute the petitioner's contention regarding the applicability of previous judgments.
What were the issues?
1. Whether the issuing authority had the jurisdiction to issue the order under Section 148A(b) and the notice under Section 148 of the Income Tax Act, 1961, for AY 2020-2021, in light of the CBDT circular dated 29.03.2022, which allegedly vests exclusive power in the NFAC. The assessee argued that the CBDT circular dated 29.03.2022 specifically states that the NFAC has exclusive power to issue notices under Section 148 of the Act, thereby rendering the impugned order and notice invalid due to lack of jurisdiction. The revenue did not dispute this contention and implicitly conceded that the issue is covered by prior judgments of the High Court.
