SURESH CHAND PROPRIETOR AGGARWAL FOODS,KARNAL vs. CENTRAL BOARD OF DIRECT TAXES AND OTHERS
What did the High Court hold?
The High Court held that notices issued under Section 148 of the Income Tax Act, 1961, and dispatched prior to 01.04.2021, were not required to be preceded by any notice under Section 148A, as Section 148A was prospectively introduced and came into effect on or after 01.04.2021. Consequently, such notices would continue to be governed by the unamended provisions. The court referred to the Supreme Court's decision in Union of India vs. Ashish Agarwal, which, while allowing certain benefits of the new provisions to notices issued on or after 1st April 2021, did not mandate the Section 148A procedure for notices issued before that date. The court found no justifiable reason to interfere with the impugned notice. However, it granted the petitioner liberty to file a written response to the notice, after which the Assessing Officer would proceed with the assessment in accordance with law. The operative direction was to allow the petitioner to respond to the notice.
What were the facts?
The petitioner, Suresh Chand, filed a writ petition challenging a notice dated 31.03.2021 issued under Section 148 of the Income Tax Act, 1961, for assessment year 2014-15. The challenge was based on the ground that the notice was not preceded by the procedure prescribed under Section 148A of the Act, which was introduced by the Finance Act, 2021. The court noted that the impugned notice was dispatched to the petitioner prior to 01.04.2021. The judgment refers to a Supreme Court decision in Union of India vs. Ashish Agarwal, which dealt with similar issues concerning the applicability of Section 148A to notices issued before its effective date.
What were the issues?
1. Whether a notice issued under Section 148 of the Income Tax Act, 1961, on 31.03.2021, for assessment year 2014-15, is invalid for not being preceded by the procedure prescribed under Section 148A of the Act, considering Section 148A was introduced prospectively from 01.04.2021. Assessee's contention: The notice is invalid as it was not preceded by the mandatory procedure under Section 148A, which was in effect at the time of issuance. Revenue's contention: Notices issued prior to 01.04.2021 are governed by the unamended provisions and are not required to be preceded by Section 148A. The judgment relies on the Supreme Court's decision in Union of India vs. Ashish Agarwal, which held that notices issued on or after 1st April 2021 would be deemed to have been issued under Section 148A and construed as show-cause notices, with certain directions for compliance.

CWP-2171-2022 -2- which was produced before us, such notice was dispatched to the petitioner prior to 01.04.2021. 4. Notices under Section 148 of the Act, issued and dispatched prior to 01.04.2021, were not required to be preceded by any notice under Section 148A of the Act because Section 148A was prospectively introduced through the Finance Act, 2021 and was to come into effect on or after 01.04.2021. Therefore, such notices would continue to be governed by the unamended provisions.
