What did the High Court hold?

The High Court accepted the consensus arrived at between the parties. The assessment order dated 23.03.2026 was set aside. The respondent (Income Tax Officer) was granted liberty to pass a fresh assessment order, but only after considering the objections dated 26.04.2025 raised by the petitioner in response to the notice dated 31.03.2025 under Section 148 of the Act. The court found merit in the petitioner's submission regarding the violation of the principle of natural justice. The revenue acknowledged the issue and consented to a fresh assessment after due consideration of objections. The ratio is that an assessment order passed without considering the assessee's objections to a Section 148 notice violates natural justice and is liable to be quashed, with liberty to pass a fresh order after proper adjudication of objections.

What were the facts?

The petitioner, Ominder Singh Oberoi, received a notice under Section 148 of the Income Tax Act, 1961, dated 31.03.2025, for assessment year 2020-21, alleging non-accounting of capital gains from land sale in Kasauli. The petitioner filed objections on 26.04.2025, claiming exemption under Section 10(37). Subsequently, notices under Section 142(1) were issued, leading to an assessment order dated 23.03.2026, demanding tax on these capital gains. The petitioner challenged this order before the High Court of Punjab and Haryana.

What were the issues?

1. Whether the assessment order dated 23.03.2026 is liable to be set aside on the ground of violation of the principle of natural justice, specifically because the petitioner's objections dated 26.04.2025 to the Section 148 notice were not considered prior to the issuance of Section 142(1) notices and the final assessment order? (Question of law and fact, concerning Section 148 and Section 142(1) of the Income Tax Act, 1961). Assessee's Contention: The assessment order is bad in law for violating the principle of natural justice as the objections filed against the Section 148 notice were not considered before passing the assessment order. Revenue's Contention: While an order was passed on 21.05.2025, it could not be communicated due to a technical glitch. The revenue agreed to set aside the impugned assessment order with liberty to pass a fresh order after considering the petitioner's objections.

Which sections of the Income-tax Act were involved?

Section 148,Section 142(1),Section 10(37)

Learned senior counsel for the petitioner submits that impugned assessment order is liable to be set aside only on the ground of violation of principle of nature justice because the objections filed by the petitioner to the initial notice under Section 148 of the Act on 26.04.2025 were never considered before either issuance of notices under Section 142(1) of the Act or passing of the impugned assessment order dated 23.03.2026. 3. In response to the afore submissions, learned counsel for the respondent submits that though an order dated 21.05.2025 was passed by respondent, but the same could not be communicated to the petitioner on account of technical glitch and, therefore, he has expressed his assertion that the impugned assessment order may be set aside with liberty to the respondent to pass a fresh assessment order, but only after considering the objections dated 26.04.2025 raised by the petitioner to the notice received by the petitioner on 31.03.2025 under Section 148 of the Act. 4.
