PRINCIPAL COMMISSIONER OF I T JAIPUR-2 vs. M/S RAJ STATE BEVERAGES CORP LTD
What did the High Court hold?
The High Court, after perusing the cited judgment in Commissioner of Income Tax Vs. M/s. Rajasthan State Ganganagar Sugar Mills Ltd., found that the law enunciated therein was mutatis mutandis applicable to the facts of the present case. Consequently, the Court dismissed the appeal. The judgment does not explicitly detail the Tribunal's reasoning for deleting the additions related to Privilege Fee or its findings on the PF/ESI contribution issue. However, by applying the precedent, it implies agreement with the Tribunal's decision on these points. The operative direction was the dismissal of the appeal.
What were the facts?
The assessee, M/s Rajasthan State Beverages Corpn. Ltd., a Rajasthan State Government undertaking, was assessed for the assessment year 2010-11. The assessing officer made an addition of Rs. 26,10,31,330/- and levied tax and interest under Sections 234A, 234B, and 234C, and initiated penalty proceedings under Section 271(1)(c). The assessee challenged the assessment order before the Commissioner of Income-tax (Appeals), who upheld the assessing officer's order. The assessee then appealed to the Income Tax Appellate Tribunal, which also upheld the appellate authority's order. The Principal Commissioner of Income Tax, Jaipur-2, has appealed this Tribunal's decision to the High Court.
What were the issues?
The Tribunal had to decide two substantial questions of law: 1. Whether the Tribunal was justified in deleting the additions made by the Assessing Authority by disallowing the Privilege Fee paid by the assessee to the Excise Commissioner, Government of Rajasthan, on the ground that it was an application of income. 2. Whether, in cases of delay in depositing employees' contribution towards PF and ESI, the matter should be governed by Section 43B of the Income Tax Act, 1961, or by Section 36(1)(va) read with Section 2(24)(x) of the Act of 1961. The revenue argued that the Privilege Fee was an application of income. The assessee relied on a division bench judgment in Commissioner of Income Tax Vs. M/s. Rajasthan State Ganganagar Sugar Mills Ltd. dated 26/05/2016.
Which sections of the Income-tax Act were involved?
Section 143(3),Section 142(1),Section 234A,Section 234B,Section 234C,Section 271(1)(c),Section 43B,Section 36(1)(va),Section 2(24)(x)
