PRINCIPAL COMMISSIONER OF IT JAIPUR-2 vs. SHRI AMIT SINGHAL
What did the High Court hold?
The High Court noted that both parties agreed to a remand of the appeals to the Assessing Officer. The Court referred to its own decision in Commissioner of Income Tax vs. M/s Aditya Gems, which in turn relied on Supreme Court and Gujarat High Court judgments (Vijay Proteins Ltd., Sanjay Oilcake Industries, N.K. Industries Ltd.). These precedents established that while the law declared in those judgments would be accepted, the genuineness of the transactions would need to be verified afresh by the Assessing Officer. Consequently, the High Court remitted both appeals back to the Assessing Officer. The AO is directed to decide the matter afresh after the parties adduce evidence, including cross-examination, and after appreciating the same, taking into consideration the aforementioned judgments. The specific findings on the issues raised by the parties were not adjudicated on merits by the High Court, as the matter was remanded.
What were the facts?
These are cross-appeals filed by the Revenue and the assessee, Shri Amit Singhal, challenging an order of the Income Tax Appellate Tribunal (ITAT). The Revenue's appeal (ITA No. 66/2017) challenges the ITAT's decision to restrict an addition of Rs. 80,51,000 made by the Assessing Officer (AO) on account of bogus purchases under Section 69C to Rs. 7,63,077. The assessee's appeal (ITA No. 123/2017) questions the ITAT's findings regarding the addition of gross profit. The High Court, in view of a previous decision in CIT vs. M/s Aditya Gems, agreed with the parties that the appeals should be remanded back to the AO for fresh adjudication.
What were the issues?
1. Whether on the facts and in the circumstances of the case and in law the ITAT is perverse in so far as it has failed to appreciate the facts of the case correctly (Revenue's contention: Yes, ITAT's appreciation was flawed). 2. Whether on the facts and circumstances of the case and in law the ITAT was justified in restricting the addition to Rs.7,63,077/- as against Rs.80,51,000/- made by the Assessing Officer on account of bogus purchases u/s 69C (Revenue's contention: No, the restriction was unjustified). 3. Whether in the facts and circumstances of the case and in law the ITAT was justified in not considering the case of the petitioner as technical & venial in the nature (Assessee's contention: Yes, the case was technical and venial). 4. Whether assessing officer without conducting proper inquiry and without confronting both the parties can made addition into total income of petitioner (Assessee's contention: No, the AO's addition was invalid). 5. Whether making of gross profit addition @ 7.5% on total alleged purchased without assigning any specific reason and without applying any scientific method thereof is justified in the facts & circumstances of the case (Assessee's contention: No, the GP addition was arbitrary). 6. Whether without doubting the payment made to seller and doing addition in Gross Profit is justified (Assessee's contention: No, the GP addition was unjustified if payments were not doubted). 7. Whether Income Tax Appellate Tribunal was justified in sustaining Gross Profit @ 7.5% as against 1.25% declared by appellant (Assessee's contention: No, the ITAT's sustenance of 7.5% GP was unjustified, and 1.25% declared by the assessee should have been accepted).
