What did the High Court hold?

The High Court noted that the counsel for the appellant (Revenue) stated that in all these appeals, the matters may be remitted back to the Tribunal on the main issue. The appellant wished to file a rectification application before the Tribunal and requested that all these matters be heard together. In view of this submission, the High Court disposed of all the appeals with liberty to the appellant to move a rectification application before the Tribunal with a request to hear all the matters together. The Court expressed hope that the Tribunal would decide all the matters together if such a request was made. No decision was made on the merits of the penalty deletion by the ITAT.

What were the facts?

The appeals were filed by the Principal Commissioner of Income Tax, Ajmer, against the orders of the Income Tax Appellate Tribunal (ITAT). The ITAT had allowed the assessee's appeals and modified the orders of the CIT(A). The assessee, M/s. Ajmer Vidyut Vitran Nigam Ltd., had filed a return declaring Nil income on 31.10.2002, which was revised to Rs. 49,70,09,117/- before depreciation on 31.10.2003. The assessment order under Section 143(3) was passed based on directions under Section 144A. During the assessment, additions were made for depreciation disallowed on non-existing assets (Rs. 21,60,26,673/-) and depreciation disallowed under Section 43(1) Explanation 10 (Rs. 18,99,41,047/-). The appeals challenge the deletion of penalties imposed under Section 271(1)(c) related to these disallowances.

What were the issues?

1. Whether, in the facts and circumstances of the case, the ITAT was justified in law in reversing the decision of the CIT(A) and deleting the penalty imposed under Section 271(1)(c) of Rs. 118,653,910/- (for Appeal No. 19/2018), Rs. 65,120,164/- (for Appeal No. 26/2018), and Rs. 124,791,823/- (for Appeal No. 31/2018) for disallowance of depreciation on non-existing assets and depreciation claimed on excess cost of assets in view of Explanation 10 to sub-section 1 of Section 43. Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The revenue, as the appellant, argued that the ITAT erred in deleting the penalties imposed under Section 271(1)(c) concerning the disallowance of depreciation on non-existing assets and on excess cost of assets, as per Explanation 10 to Section 43(1). The revenue sought to remit the matters back to the Tribunal for reconsideration of the main issue.
