THE COMMISSIONER OF INCOME TAX vs. P.P.BHASKARAN
What did the High Court hold?
The High Court noted that the issues raised in the present appeal were being reconsidered by the ITAT itself in other appeals filed by the other partners of the firm (ITA Nos. 718, 719, 724, 725, 737 and 738 of 2010). Therefore, the Court deemed it appropriate to set aside the impugned order of the ITAT and remit the matter back to the Tribunal for reconsideration. The Court vacated the ITAT's order that had set aside the addition towards undisclosed investment for Assessment Year 2005-2006 and directed that the matter be reconsidered along with the other pending appeals.
What were the facts?
The appeal was filed by the Revenue against an order of the Income Tax Appellate Tribunal (ITAT), Kochi Bench. The ITAT had set aside an addition of undisclosed investment made under Section 69 of the Income Tax Act. The addition of ₹24,83,346/- was made for Assessment Year 2005-2006, relating to an alleged undisclosed investment in a property purchased by a firm in which the respondent assessee was a partner. This assessment was completed under Section 143(3) read with Section 153C of the Income Tax Act, following a search conducted on May 30, 2007. The respondent assessee stated that similar orders were passed by the ITAT in the cases of other partners, which were later recalled, and those appeals are pending.
What were the issues?
1. Whether the ITAT was justified in setting aside the addition of undisclosed investment made under Section 69 of the Income Tax Act, 1961, for Assessment Year 2005-2006. The Revenue contended that the addition was made based on undisclosed investment in a property. The Assessee argued that similar orders for other partners were recalled by the ITAT and their appeals are pending reconsideration. The ITAT had initially set aside the addition. The High Court is considering whether to uphold the ITAT's order or to remit the matter for reconsideration.
