What did the High Court hold?

The High Court held that in the facts of the case, where the objections submitted by the petitioner in response to the Section 148 notice for Assessment Year 2014-2015 had not been considered and disposed of by the respondent, it would subserve the interests of justice to direct the competent authority to consider and dispose of these objections. The court clarified that it had not expressed any opinion on the merits of the case. Accordingly, the petition was disposed of with a direction to the respondent to consider and dispose of the petitioner's objections dated January 20, 2022, within six weeks from the receipt of the order. No specific finding was given on the validity of the reopening notice itself, as the matter was remitted for consideration of objections.

What were the facts?

The petitioner, Satish Lallan Mishra, filed a Special Civil Application under Article 226 of the Constitution of India challenging a notice dated March 30, 2021, issued by the Income Tax Officer, Ward 5(3)(1), under Section 148 of the Income Tax Act, 1961, for Assessment Year 2014-2015. The notice alleged that income chargeable to tax had escaped assessment. The petitioner filed a return of income and requested the reasons for reopening. The reasons supplied indicated that the reopening was based on information from the DCIT Central Circle - 2(1), Ahmedabad, concerning a search in the case of M/s. Dev group, which suggested the petitioner advanced cash of Rs. 3 lakhs for a flat purchase, requiring verification of the source of funds. The petitioner raised objections on January 20, 2022, arguing the reopening was unjustified. This court issued notice and granted ad-interim relief staying further proceedings.

What were the issues?

1. Whether the Income Tax Officer was justified in issuing the notice under Section 148 of the Income Tax Act, 1961, for Assessment Year 2014-2015, based on the reasons provided. The Assessee (Petitioner) contended that the objections raised by him vide his letter dated January 20, 2022, against the proposed reassessment notice, which included various factual and legal submissions, were not considered at all by the respondent Income Tax Officer. The petitioner apprehended that the authorities would proceed to frame the assessment without considering his case and defence, leading to great prejudice. The Revenue (Respondent) did not record any specific arguments in the judgment regarding the justification of the reopening or the consideration of objections.
