ARUNABEN KANAIYALAL PATEL L/R OF LATE KANAIYALAL DALSUKH PATEL vs. ASST. COMMISSIONER OF INCOME TAX, CENT. CIRCLE 2(4) OR HIS SUCCESSOR
What did the High Court hold?
The High Court held that the issue of whether a notice of reopening issued under Section 148 of the Income Tax Act, 1961, is without jurisdiction when served on a deceased assessee is no longer res integra. The Court relied on its own decision in Bhupendra Bhikhalal Desai Vs. Income Tax Officer, which was affirmed by the Supreme Court with the dismissal of the Revenue's Special Leave Petition on September 27, 2021. Consequently, the writ application was allowed, and the impugned notice was quashed and set aside. All consequential proceedings pursuant to the notice were also terminated. The ratio decidendi is that a notice issued under Section 148 to a dead assessee is invalid and without jurisdiction.
What were the facts?
The petitioner, through her legal heir, filed a writ application challenging a notice dated March 13, 2021, issued under Section 148 of the Income Tax Act, 1961, for reopening the assessment for Assessment Year (AY) 2016-17. The primary ground for challenge was that the notice was issued without jurisdiction, as it was served on a deceased assessee. The petitioner sought to quash the notice, obtain the reasons recorded for reopening, and maintain status quo pending the disposal of the petition. The Revenue was represented by Mr. M.R. Bhatt.
What were the issues?
1. Whether the notice of reopening issued under Section 148 of the Income Tax Act, 1961, for AY 2016-17 is without jurisdiction if it has been issued to a dead assessee? Assessee's Contention: The assessee argued that the impugned notice was issued without jurisdiction because it was served on a deceased assessee, rendering it invalid. Revenue's Contention: The judgment does not record specific arguments made by the Revenue. However, the Revenue was represented by learned senior advocate Mr. M.R. Bhatt.
