What did the High Court hold?

The High Court held that the issue of a notice of reopening under Section 148 to a deceased assessee is no longer res integra, citing its own decision in Bhupendra Bhikhalal Desai Vs. Income Tax Officer. The Court noted that this decision was affirmed by the Supreme Court with the dismissal of the Revenue's Special Leave Petition. Consequently, the writ application was allowed, and the impugned notice was quashed and set aside. All consequential proceedings were also terminated. The ratio decidendi is that a notice under Section 148 issued to a deceased assessee is void ab initio.

What were the facts?

The petitioner, through her legal heir, filed a writ application challenging a notice dated March 28, 2021, issued under Section 148 of the Income Tax Act, 1961, for the Assessment Year 2014-15. The primary ground for challenge was that the notice was issued without jurisdiction as it was served on a deceased assessee. The petitioner sought to quash the notice, obtain the reasons recorded for reopening, and stay further proceedings. The respondent was the Assistant Commissioner of Income Tax.

What were the issues?

1. Whether a notice of reopening issued under Section 148 of the Income Tax Act, 1961, to a deceased assessee is without jurisdiction and liable to be quashed? (Question of law). The petitioner argued that the notice was invalid as it was issued to a dead person, rendering it without jurisdiction. The revenue did not record any specific arguments in the judgment.
