ARUNABEN KANAIYALAL PATEL L/R OF LATE KANAIYALAL DALSUKH PATEL vs. ASST. COMMISSIONER OF INCOME TAX, CENT. CIRCLE 2(4) OR HIS SUCCESSOR
What did the High Court hold?
The High Court held that the issue of a notice of reopening under Section 148 of the Income Tax Act, 1961, to a dead assessee is without jurisdiction. The Court relied on its own decision in Bhupendra Bhikhalal Desai Vs. Income Tax Officer, which was affirmed by the Supreme Court through the dismissal of a Special Leave Petition filed by the Revenue. Consequently, the impugned notice of reopening was quashed and set aside. All consequential proceedings arising from this notice were also terminated. The Court found the writ application to be successful.
What were the facts?
The petitioner, Arunaben Kanaiyalal Patel, through her legal heir, filed a writ application under Article 226 of the Constitution of India. The challenge was to a notice of reopening issued under Section 148 of the Income Tax Act, 1961, for Assessment Year (AY) 2013-14. The primary ground for the challenge was that the notice was issued without jurisdiction because it was served on a dead assessee. The petitioner sought to quash the notice, obtain the reasons recorded for reopening, and stay further proceedings.
What were the issues?
1. Whether a notice of reopening issued under Section 148 of the Income Tax Act, 1961, is valid if it is issued to a dead assessee? (Question of law) Assessee's contention: The assessee argued that the notice of reopening was issued without jurisdiction as it was served on a deceased individual, rendering it invalid. The assessee relied on the High Court's decision in Bhupendra Bhikhalal Desai Vs. Income Tax Officer. Revenue's contention: The judgment does not record any specific contentions made by the Revenue. However, the Revenue was represented by counsel.
