What did the High Court hold?

The High Court allowed the petition. It held that the notices and orders issued to the deceased assessee, after the department was aware of the death and had acknowledged the legal heir's status, were void ab initio. The court reasoned that issuing notices to a deceased person, subsequent to the department's acknowledgment of the death and the legal heir's identity, renders such proceedings invalid. The court specifically quashed and set aside the assessment order dated March 22, 2022, for Assessment Year 2014-15, along with all consequential notices. The ratio decidendi is that procedural fairness and adherence to legal provisions mandate that proceedings should not be initiated or continued against a deceased individual once their demise and the identity of their legal representative are known to the tax authorities.

What were the facts?

The petitioner, representing the legal heirs of the deceased Shamjibhai Jinabhai Sagpariya, filed a Special Civil Application challenging notices and orders issued by the Income Tax Officer, Ward - 2 (1)(1) RKT. The deceased passed away on August 20, 2017. The petitioner communicated the death to the department on March 29, 2019, and requested to be recognized as a legal heir with a specific PAN, which was allowed on March 30, 2019. Despite this, the department continued to issue notices to the deceased. The impugned notices and orders, including a show cause notice dated March 10, 2022, and a final assessment order dated March 22, 2022, for Assessment Year 2014-15, were issued after the department was aware of the assessee's death and had acknowledged the legal heir's status.

What were the issues?

1. Whether notices and orders issued by the respondent authority to a deceased assessee, after the department was duly informed of the death and the legal heir was recognized, are void ab initio? (Question of law and fact, turning on principles of natural justice and procedural validity). Assessee's Contention: The petitioner argued that since the department was informed of the assessee's death on March 29, 2019, and the legal heir's request was approved on March 30, 2019, any subsequent notices issued to the deceased are void. The petitioner relied on the decisions in Kanubhai Jinabhai Patel vs. Income-tax Officer and Savita Kapila vs. Assistant Commissioner. Revenue's Contention: The revenue, represented by learned senior standing counsel, did not dispute the fact that the department had been communicated the death well in time and had granted its approval.
