What did the High Court hold?

The High Court noted that a co-ordinate Bench in the matter of Commissioner of Income Tax v. Gauranginiben S. Shodhan Indl. had already answered the substantial question of law concerning the provisions of Section 55A of the Income Tax Act, 1961. The learned counsel for the appellant stated that since this question was answered in favor of the appellant, he would not press the first substantial question of law regarding the invocation of Section 147. Consequently, the appeal was allowed by answering the substantial question of law in favor of the assessee, based on the precedent in Gauranginiben’s case. No orders as to costs were made. The issue concerning Section 147 was not decided on merits as it was not pressed.

What were the facts?

The appeal was filed by Zaverchand Gaekwad Limited against an order of the Income Tax Appellate Tribunal. The assessment year in question is 2000-01. The Revenue had initiated reassessment proceedings under Section 147 of the Income Tax Act, 1961, and made a reference to the District Valuation Officer under Section 55A for ascertaining the fair market value of a property as of April 1, 1981. The Tribunal had upheld the Assessing Officer's actions. The appeal was before the High Court of Gujarat.

What were the issues?

The High Court had to decide two substantial questions of law: 1. Whether the Income Tax Appellate Tribunal was right in law in holding that the Assessing Officer was justified in invoking the provisions of Section 147 of the Income Tax Act, 1961, for reopening the assessment for Assessment Year 2000-01. 2. Whether the Income Tax Appellate Tribunal was right in law in holding that the Assessing Officer was justified in making a reference under Section 55A of the Income Tax Act, 1961, to the District Valuation Officer for ascertaining the Fair Market Value of the property as on 01.04.1981. Arguments: Assessee: The learned counsel for the appellant submitted that in light of substantial question of law no. 2 being answered in favor of the appellant by this Court, he would not press substantial question of law no. 1. Revenue: No arguments were recorded for the Revenue on these specific questions.
