What did the High Court hold?

The High Court dismissed the appeal filed by the Revenue. The Court noted that the ITAT's finding was a concluded finding of fact. The Court referred to the Apex Court's decisions in CIT v. Stellar Investment Ltd. (251 ITR 263) and CIT v. Lovely Exports (P) Ltd. (216 CTR 195), which held that if the identity of persons who invested in shares is established, then such income cannot be added to the assessee's income. The Court reasoned that even assuming the share application money was taxed, the identity of the persons was identified by documents like ration cards and election cards. Therefore, the addition made by the AO under Section 68 was considered wholly unjustified. The Court found no substantial question of law arising for consideration and dismissed the appeal.

What were the facts?

The Revenue (Commissioner of Income Tax II) filed a Tax Appeal before the High Court of Gujarat challenging an order of the Income Tax Appellate Tribunal (ITAT). The ITAT had upheld the deletion of an addition of Rs. 23,50,000 made by the Assessing Officer (AO) under Section 68 of the Income Tax Act, 1961. This addition was on account of unaccounted share application money. The Commissioner of Income Tax (Appeals) had initially deleted the addition, stating that share application money could not be treated as income unless the identity of the depositors was established. The ITAT affirmed this finding. The appeal was heard by the High Court, with the Revenue represented by counsel and the assessee (Maruti Aluminium Pvt Ltd) not appearing.

What were the issues?

1. Whether the Appellate Tribunal is right in law and on facts in deleting the addition made under Section 68 of the Income Tax Act, 1961? Assessee's Contention: The judgment does not record any specific contentions made by the assessee before the High Court. However, the reasoning of the lower appellate authorities, which was affirmed by the Tribunal, suggests that the assessee likely argued that the share application money should not be treated as income if the identity of the investors was established. Revenue's Contention: The Revenue argued that the addition made by the AO under Section 68 was justified. The judgment does not explicitly detail the Revenue's arguments beyond the fact that they are challenging the deletion of the addition.

TAXAP/330/2011 2/2 JUDGMENT questions: “Whether the Appellate Tribunal is right in law and on facts in deleting the addition u/s.68 of the Act?” 2. We have heard Ms. Mauna M. Bhatt, learned counsel for the Revenue. Addition made under Section 68 of the Income Tax Act, 1961 of Rs.23,50,000/- on account of unaccountable share application money has been added tot he income of the assessee. IN appeal filed by the assessee, the Commissioner of Income Tax (Appeal) deleted the additions on the ground that unless the identity of the depositors is established, till then share application money could not be treated to be income of the assessee. The Tribunal has affirmed the finding. We are of the opinion that in view of the decision of the Apex Court in CIT v. Stellar Investment Ltd. (251 ITR 263) and CIT v. Lovely Exports (P) Ltd. (216 CTR 195), the Apex court has held that where the CIT established the identity of the persons who have invested in the shares, then such income could not be added in the income of the assessee. The reasoning given by the Tribunal is concluded finding of fact. Assuming that the share application money was taxed, even then the identity of the persons is identified by ration cards, election cards, etc. Therefore, the addition made by the assessing officer in the income of the assessee under Section 68 of the Act is wholly unjustified. We do not find any substantial question of law that arises for consideration in this appeal. This Appeal fails and is accordingly dismissed. (V.M. SAHAI, J.) (N.V. ANJARIA, J.) (SN DEVU PPS)
