COMMISSIONER OF INCOME TAX - GANDHINAGAR vs. GUJARAT URBAN DEVELOPMENT CORPORATION LTD
What did the High Court hold?
The High Court of Gujarat, while hearing the appeal, noted that the issue raised was covered by its own prior decision in Tax Appeal No. 118/2014. The Court referred to the substantial questions of law raised in that prior appeal, which included a similar question regarding the taxability of interest receipts on unutilized funds parked in fixed deposits. The Court stated that it was in complete agreement with the view taken by the Tribunal in the prior matter concerning the deletion of additions made on account of interest accrued on FDRs. Consequently, the High Court found no merit in the present appeal and dismissed it. The decision was held in favour of the assessee and against the Department.
What were the facts?
The assessee, Gujarat Urban Development Corporation Ltd., was subjected to scrutiny assessment for Assessment Year 2010-2011. The Assessing Officer (AO) made an addition of Rs. 20,18,23,408/- on account of interest received on funds kept in fixed deposits, which the assessee had not offered for tax. The assessee's appeal to the Commissioner of Income Tax (Appeals) was dismissed. However, the Income Tax Appellate Tribunal (ITAT) allowed the assessee's appeal, relying on its prior decision for Assessment Year 2007-08 and High Court judgments in Gujarat Municipal Finance Board vs. Dy.CIT and Gujarat Power Corporation Ltd. vs. ITO. The Revenue (Commissioner of Income Tax - Gandhinagar) appealed this ITAT order to the High Court of Gujarat.
What were the issues?
1. Whether the ITAT was justified in holding that the interest receipt of Rs. 20,18,23,408/- is not taxable in the hands of the assessee when the funds remained unutilized by the assessee and were parked in fixed deposits in the assessee's own name on a long-term basis. (Question of law) Assessee's Contentions: The ITAT was justified in its decision, relying on its previous ruling for AY 2007-08 and the jurisdictional High Court's decisions in Gujarat Municipal Finance Board vs. Dy.CIT (1996) 221 ITR 317 and Gujarat Power Corporation Ltd. vs. ITO (2013) 354 ITR 201 (Guj.). Revenue's Contentions: (Not recorded in the judgment. The judgment states "Heard learned Advocates for the parties" but does not detail the revenue's arguments beyond the substantial question of law raised.)

O/TAXAP/1248/2014 JUDGMENT assessment and all the assessment u/s. 143(3) of the Income Tax Act, 1961 was framed vide order dated 24/12/2012. The Assessing Officer made addition of Rs.20,18,23,408/- on account of interest received under various heads of grant during the year which were kept in Fixed Deposit receipt in the name of assessee and not offered for tax. Against this, the assessee filed an appeal before the CIT(A) who after considering the submissions of the assessee, dismissed the appeal of the assessee. The ITAT has allowed the appeal of the assessee by relying the similar issue in A.Y. 2007-08 (ITA No.1116/Ahd/2011), wherein decided issue in favour of assessee following the Jurisdictional High Court rendered in the case of Gujarat Municipal Finance Board vs. Dy.CIT reported at (1996) 221 ITR 317 as well as in the case of Gujarat Power Corporation Ltd. vs. ITO reported at (2013) 354 ITR 201 (Guj.)
