What did the High Court hold?

The High Court held that questions (A) to (D) concerning the bad debt claim arising from lease financing were decided by a separate order in Tax Appeal No. 1024 of 2018, where such questions were declined. Question (E) regarding depreciation on leased assets was considered in Tax Appeal No. 1023 of 2018 and dismissed. For question (F), concerning the addition to book profit under Section 115JB, the Tribunal had deleted the addition, relying on the Supreme Court judgment in Apollo Tyres Ltd. vs. Commissioner of Income-tax, reported in 255 ITR 273. The High Court, by referring to its decisions on related appeals and the Tribunal's reliance on the Apollo Tyres case, implicitly upheld the Tribunal's findings on these issues. The operative direction was to dismiss the tax appeal.

What were the facts?

The Revenue has filed this appeal against the order of the Income Tax Appellate Tribunal (ITAT) for the assessment year 2004-05. The appeal raises several questions concerning the assessee, Gujarat Lease Financing Ltd. The core of the dispute revolves around the assessee's claim for bad debts arising from its lease financing business, the treatment of hire purchases as stock-in-trade, the allowability of depreciation on leased assets, and an addition to the book profit under Section 115JB of the Income Tax Act. The ITAT had previously ruled on similar issues in related appeals filed by the same assessee.

What were the issues?

The Tribunal had to decide the following questions of law: 1. Whether the bad debt claim of the assessee was allowable under Section 36(1)(viii) of the IT Act, considering the debts were not trading debts and the principal amount debited could not be a trade debt. 2. Whether hire purchases were correctly treated as stock-in-trade by the Tribunal. 3. Whether bill discounting could be accepted as a trading receipt and the resultant debt treated as a bad trading debt, given the assessee is not a banking entity. 4. Whether the disallowance of depreciation amounting to Rs. 9,25,304 on leased assets was correctly deleted by the Tribunal. 5. Whether an addition of Rs. 14,64,19,561 to the book profit under Section 115JB of the Act was correctly made, contrary to Explanation 1 of Section 115JB. Assessee's Contentions: The judgment does not record specific contentions made by the assessee. The issues are framed from the Revenue's perspective. Revenue's Contentions: The Revenue contended that the debts were not trading debts as required by Section 36(1)(viii), that the principal amount debited could not be a trade debt, that hire purchases were wrongly treated as stock-in-trade, that bill discounting should not be considered a trading receipt for a non-banking entity, that depreciation on leased assets was wrongly deleted, and that the addition to book profit under Section 115JB was justified.
