C.I.T. vs. CADILA ANTIBIOTICS LTD.
What did the High Court hold?
The High Court held that both References are answered in favour of the Assessee and against the Revenue. The Court noted that Section 32AB of the Income-tax Act, 1961, allows for a deduction where an assessee deposits an amount in a specified account or utilizes it for purchasing new assets. The assessee had deposited an amount in the IDBI Bank account on 25.09.1989. The requirement under the Act was to debit the amount within six months from the end of the financial year or by 30th September of the next financial year. Crucially, the revenue's counsel was unable to demonstrate that this debiting requirement was not met. The Court also referred to the Patna High Court's decision in CIT v. Chanchani Brothers (Contractors) Pvt. Ltd., which discussed the accrual of liabilities under the mercantile system. Given the lack of contrary evidence from the revenue and the assessee's compliance with the deposit provision, the Tribunal's decision allowing the deduction was upheld. The operative direction is that the references are answered in favour of the assessee.
What were the facts?
This judgment concerns two Income Tax References (Nos. 23 and 24 of 2003) before the High Court of Gujarat at Ahmedabad. The references were made by the Commissioner of Income-Tax (the applicant/revenue) against Cadila Antibiotics Ltd. (the respondent/assessee). The core issue revolves around the assessee's entitlement to a deduction under Section 32-AB of the Income-tax Act, 1961. The specific point referred to the Tribunal was whether the Tribunal was justified in holding that the assessee was entitled to this deduction. The judgment does not specify the assessment year(s) or the amount in dispute. The procedural history indicates that the matter was first considered by the Income Tax Appellate Tribunal, Ahmedabad Bench 'B', which made a decision in favour of the assessee, leading to these references to the High Court.
What were the issues?
1. Whether, on the facts and in the circumstances of the case, the Tribunal was justified in law in holding that the assessee was entitled to deduction under section 32-AB of the Income-tax Act, 1961? Assessee's Contentions: The assessee relied on Section 32AB of the Income-tax Act, 1961, which deals with investment deposit accounts and the utilization of funds for new machinery. The assessee argued that an amount was deposited in the account of IDBI Bank on 25.09.1989. They further contended that in view of the provisions of Section 32AB, the amount was required to be debited within six months from the end of the financial year or by 30th September of the next financial year. The assessee also referred to the decision of the Patna High Court in CIT v. Chanchani Brothers (Contractors) Pvt. Ltd. (161 ITR 418) regarding the accrual of liabilities under the mercantile system of accounting and the scheme of the Act, specifically Sub-Clause 4 concerning the manner of deposit. Revenue's Contentions: The revenue, represented by the learned Senior Counsel, was not in a position to show that the amount was not debited on 30th September from the account of the assessee. No specific authorities or circulars were cited by the revenue.

Chanchani Brothers (Contractors) Pvt. Ltd. reported in 161 Income Tax Reports 418. The relevant part (Head Note) of the decision reads as under :- “Though under the mercantile system of accounting all items of credit into credit immediately they become legally due and before they are actually
received,
and
all expenditure is debited, for which a legal liability has been incurred before it is actually disbursed, yet before a credit or debit entry can legitimately be made in the accounts, it must be shown that a certain enforceable liability has accrued or arisen and that such liability must be one that has been ascertained and capable of being enforced by the person in whose favour the debit has been raised.” Page 3 of 5
O/ITR/23/2003 JUDGMENT 4.Learned Senior Counsel also pointed to the Scheme of the Act as also to Sub-Clause 4, i.e. Manner of Deposit which reads as under :- “(3) Every subsequent deposit shall be made into the deposit Office at which the account stands by crossed cheque or demand draft drawn in favour of such office at a bank situated at the place where the deposit office is situated” (Emphasis given).” Learned Senior Counsel therefore, contended that from the records it is clear that the amount was deposited in the account of IDBI Bank on 25.09.1989. In view of provisions of Section 32AB of the Act, it is required to be debited within six months from the end of the financial year or/and on 30th SEPTEMBER of the next financial year. 5.However, learned Senior Counsel for the appellant was not in a position to show that the amount was not debited on 30th SEPTEMBER from the account of the assessee. 6.In the aforesaid circumstances, we are of the view that both the References are answered accordingly in favour of the Assessee and against the Revenue.
