What did the High Court hold?

The High Court held that the appeal succeeds in part. The Court agreed with the appellant and the consensus reached by both parties that the addition of 15% towards future prospects was erroneous, especially considering the deceased's age of 57 years and her status as a salaried employee with a fixed date of superannuation. The Court cited the decision in Sarla Verma (Smt) and others (supra) to support this view. Consequently, the impugned judgment and award were modified. The calculation was revised: the deceased's salary of Rs. 26,245/- (rounded to Rs. 26,300/-) was considered, 10% was deducted for income tax, resulting in Rs. 23,700/- per month. After deducting 1/3rd for personal expenses, the dependency came to Rs. 15,900/- per month. Applying a multiplier of 9, the future economic loss was calculated at Rs. 17,17,200/-. Adding Rs. 10,000/- for loss to the estate, Rs. 10,000/- for loss of consortium, and Rs. 5,000/- for funeral expenses, the total compensation was determined to be Rs. 17,42,200/-. This amount, with 9% interest from the date of application, was awarded instead of the tribunal's Rs. 19,94,000/-. The operative direction was to modify the award to the reduced sum.

What were the facts?

The appellant, Reliance General Insurance Company Ltd., is challenging an award dated 26/7/2003 passed by the Motor Accident Claims Tribunal (Main), Gandhinagar, in Motor Accident Claim Petition No. 402 of 2010. The tribunal had partly allowed the claim petition, awarding Rs. 19,94,000/- as compensation for the death of the deceased, Vinaben, who was a pedestrian. The accident occurred on 26/7/2010 involving a Travera Car driven by opponent No. 1. The claimants (respondent Nos. 2/1 to 2/3) had initially claimed Rs. 31 Lacs. The tribunal found the driver 100% negligent, which was not challenged by the appellant. The tribunal calculated compensation based on the deceased's salary of Rs. 26,245/-, adding 15% for future prospects, deducting income tax, and then 1/3rd for personal expenses, arriving at a dependency of Rs. 18,000/- per month. Applying a multiplier of 9 (for the deceased's age of 57 years), the tribunal awarded Rs. 19,44,000/- for future economic loss, along with other heads of compensation.

What were the issues?

1. Whether the learned tribunal has materially erred in adding 15% towards prospective income/future prospects, considering the deceased was aged 57 years and a salaried person, as per the decision in Sarla Verma (Smt) and others Versus Delhi Transport Corporation and another. Assessee's Contention: The appellant (Insurance Company) argued that the learned tribunal erred in adding 15% towards prospective income/future prospects because the deceased was 57 years old and a salaried person. They relied on the Supreme Court's decision in Sarla Verma (Smt) and others, which, according to them, indicated that no further addition was required for future prospects in such cases. Therefore, the award should be modified to delete this addition. Revenue's Contention: The learned advocate for the original claimants initially opposed the appeal but later reached a broad consensus with the appellant. They agreed that the 15% addition towards future prospects should be deleted or set aside, and the impugned judgment and award should be modified accordingly.
