What did the High Court hold?

The High Court held that in view of its own judgment and order passed in Tax Appeal No. 408 of 2012 dated February 17, 2020, the substantial questions of law as proposed by the Revenue are answered against the Revenue and in favour of the assessee. Consequently, the appeal filed by the Revenue fails and is hereby dismissed. The reasoning for this decision is directly linked to the prior judgment of the same Court in Tax Appeal No. 408 of 2012, which presumably addressed the underlying issues concerning the applicability of Section 2(15) and its consequences on the assessee's exemptions and registration. The operative direction is the dismissal of the Revenue's appeal.

What were the facts?

The Revenue has filed this Tax Appeal under Section 260A of the Income Tax Act, 1961, challenging an order dated July 30, 2019, passed by the Income Tax Appellate Tribunal (ITAT), Ahmedabad Bench. The appeal pertains to Assessment Year 2009-10 and concerns the Gujarat Maritime Board (assessee). The core of the dispute revolves around the denial of benefits under Sections 11 and 12 of the Act by the Assessing Officer and CIT(A), which the ITAT allegedly negated. The Revenue also questions the ITAT's allowance of 15% accumulation and deletion of a deduction in fixed assets, linking these to the applicability of the proviso to Section 2(15) read with Section 13(8) of the Act. A prior Tax Appeal No. 408 of 2012, concerning the restoration of registration under Section 12AA, is also mentioned.

What were the issues?

The Tribunal had to decide the following substantial questions of law: 1. Whether the Tribunal was justified in negating the findings of the CIT(A) and Assessing Officer by denying the benefits of Sections 11 and 12 of the Act, invoking the proviso to Section 2(15) read with Section 13(8) of the Act? 2. Whether the Tribunal was justified in allowing the assessee's appeal without appreciating that the Revenue had filed Tax Appeal No. 408 of 2012 before this Court against the decision of the Tribunal restoring registration under Section 12AA of the Act cancelled by the CIT? 3. Whether the Tribunal was justified in allowing the accumulation of 15% when, upon applicability of Section 2(15) read with Section 13(8), the assessee forfeits all exemptions under Sections 11 and 12 of the Act? 4. Whether the Tribunal was justified in deleting the deduction in fixed assets of Rs. 34,49,94,135/- when, upon applicability of Section 2(15) read with Section 13(8), the assessee forfeits all exemptions under Sections 11 and 12 of the Act? Assessee's Contentions: Not recorded in the judgment. Revenue's Contentions: The Revenue argued that the Tribunal erred in negating the denial of benefits under Sections 11 and 12 by invoking the proviso to Section 2(15) read with Section 13(8). They contended that the Tribunal's allowance of accumulation and deletion of fixed asset deductions was unjustified, as the applicability of Section 2(15) r.w. Section 13(8) should lead to forfeiture of all exemptions. The Revenue also highlighted their pending appeal (Tax Appeal No. 408 of 2012) regarding the restoration of Section 12AA registration.

Which sections of the Income-tax Act were involved?

Section 260A,Section 11,Section 12,Section 2(15),Section 13(8),Section 12AA

ORAL JUDGMENT (PER : HONOURABLE MR.JUSTICE J.B.PARDIWALA) This Tax Appeal under Section 260A of the Income Tax Act, 1961, is at the instance of the Revenue and is directed against C/TAXAP/18/2020                                                                                                 JUDGMENT the order passed by the Income Tax Appellate Tribunal, 'C' Bench, Ahmedabad, dated 30th July 2019, in the ITA No.2991/Ahd/2013 for the Assessment Year 2009-10. The Revenue has proposed the following substantial questions of law for the consideration of this Court : “(A) Whether on the facts and in the circumstances of the case, the Appellate Tribunal is justified in negating the findings of the CIT(A) as well as the Assessing Officer denying the benefits of Sections 11 and 12 of the Act by invoking proviso to Section 2(15) r.w. Section 13(8) of the Act? (B) Whether on the facts and in the circumstances of the case, the Appellate Tribunal is justified in allowing the assessee's appeal without appreciating that Revenue has filed Tax Appeal No.408 of 2012 before this Hon'ble Court against the decision of the Appellate Tribunal restoring registration under Section 12AA of the Act cancelled by the CIT ? (C) Whether on the facts and in the circumstances of the case, the Appellate Tribunal is justified in allowing the accumulation of 15% without appreciating the fact that once the provision of Section 2(15) r.w. Section 13(8) is applicable, the assessee forfeits all the exemptions under Sections 11 and 12 of the Act ? (D) Whether on the facts and in the circumstances of the case, the Appellate Tribunal is justified in deleting the C/TAXAP/18/2020                                                                                                 JUDGMENT deduction in the fixed assets of Rs.34,49,94,135/- without appreciating the fact that once the provision of Section 2(15) r.w. Section 13(8) is applicable, the assessee forfeits all the exemptions under Sections 11 and 12 of the Act ?” In view of the judgment and order passed by this Court in the Tax Appeal No.408 of 2012 dated 17th February 2020, the substantial questions of law as proposed by the Revenue are answered against the Revenue and in favour of the assessee.

The Appeal fails and is hereby dismissed. (J. B. PARDIWALA, J.) (BHARGAV D. KARIA, J.) /MOINUDDIN
