SHRIRAM ASHAPURAN CHARITABLE TRUST,JAIPUR vs. THE CIT EXEMPTION, JAIPUR, JAIPUR
What did the Tribunal hold?
The Tribunal held that the impugned order passed by the CIT(E) was to be set aside. The reasoning was that the approval under Section 80G of the Act is consequential to registration under Section 12AB. The Tribunal noted that the assessee had already applied for registration under the Rajasthan Public Trust Act, 1959, and that the matter had previously been remanded for a fresh decision on Section 12AB registration. Therefore, the Tribunal decided to send the case back to the CIT(E) to decide afresh after providing the appellant with an adequate opportunity of being heard, contingent upon the registration under Section 12AB. The appeal was allowed for statistical purposes.
What were the facts?
The assessee, Shriram Ashapuran Charitable Trust, filed an appeal against an order dated 28.02.2026 passed by the Commissioner of Income Tax (Exemption), Jaipur (CIT(E)). The CIT(E) rejected the trust's application for renewal of approval under Section 80G of the Income Tax Act, 1961. The rejection was based on the grounds that the trust had not yet obtained registration under Section 12AB of the Act, nor had it secured registration under the Rajasthan Public Trust Act, 1959. The trust contended that it had provided replies regarding its activities and had applied for registration under the Rajasthan Public Trust Act, 1959, and requested more time from the CIT(E). The Tribunal had previously remanded the case for a fresh decision on Section 12AB registration.
What were the issues?
1. Whether the Commissioner of Income Tax (Exemption) was justified in rejecting the assessee's claim for renewal of approval under Section 80G on the grounds that registration under Section 12AB had not been obtained. Assessee's Contention: The assessee argued that the rejection was arbitrary and untenable. They stated that they had furnished replies regarding their charitable activities, including providing fodder for cows and maintaining shelter homes, and had submitted documents. They also claimed to have applied for registration under the Rajasthan Public Trust Act, 1959, and requested more time from the CIT(E), which was not granted. The assessee further contended that the rejection was made without issuing a show cause notice or providing a sufficient opportunity of being heard, and that the burden of proof lay with the CIT(E). Revenue's Contention: The revenue's position, as reflected in the CIT(E)'s order, was that renewal of approval under Section 80G cannot be granted without registration under Section 12AB and registration under the Rajasthan Public Trust Act, 1959.

The Appellant, Shriram Ashapuran Charitable Trust by filing the present appeal, sought to set aside the impugned order dated 28.02.2026 passed by the Commissioner of income Tax (Exemption), Jaipur [hereinafter referred to as the ‘CIT(E)’] on the grounds inter-alia that:- “1. That on the facts and in law, the impugned order dated 28/02/2026 on form no. 10AD accompanied with annexure, passed by the Id. renewal of approval u/s. 80G cannot be granted without registration u/s.12AB is most arbitrary, unjust, untenable and liable to be cancelled.
That the observation of the Id. CIT Exemption that the assessee has failed to furnish any reply in regard to genuineness of activities is incorrect and far away from truth because the fact is that vide letter of reply dated 06/02/2026 the appellant trust duely filed reply that the charitable activities of the assessee trust include providing of fodder( food for cows) to cows, planting trees in Gaushala at Bagru Khurd managed by the assessee trust. Besides it has incurred maintenance expenses in the nature of cost of tripal, iron and cement pipes, hardware items etc and labour charges for making shelter homes for cows in Gaushala, namely, Shri Ram Asha Puran Gaushala, Bagru Khurd.
That the Id. CIT Exemption failed to appreciate that in response to notice dated 03/02/2026 the assessee vide a detailed letter of reply dated 06/02/2026 had furnished almost all details and filed documents required from it by the Id CIT Exemption.
That the Id. CIT(Exemption) to give it some more time but the Id. CIT(E) did not grant time and instead rejected the assessee's application requesting to grant renewal of registration under section 12AB of the I.T. Act.
That the Id. CIT Exemption should appreciate that humble appellant has successfully filed application on Form 6 as per Rule 17(2) before the Assistant Commissioner, Department of Devasthan, Jaipur-1, State of Rajasthan on 23/03/2026 for registration under the Rajasthan Public Trust Act, 1959 and is hopeful to get registered under Rajasthan Public Trust Act, 1959.
That the ld. CIT Exemption was not justified to reject assessee's claim of granting renewal of approval u/s.80G without issuing any show cause notice and without providing reasonable and sufficient opportunity of being heard to the assessee.
That the learned CIT (Exemption) failed to discharge the burden of proof which squarely lay upon him before rejecting the assessee's application on form 10AB seeking renewal of approval under section 80G(5) of the I.T. Act, 1961.
