What did the Tribunal hold?

The Tribunal condoned the delay of 39 days in filing the appeal before the FAA. The Tribunal found that the reasons advanced by the assessee, namely the authorized representative being occupied with arrangements for his son's marriage, were sufficient in the interest of justice and fair play. Consequently, the Tribunal restored the matter to the file of the FAA for adjudication on merits. The assessee was directed to extend full co-operation and not seek unnecessary adjournments. The appeal was allowed for statistical purposes. No issue was expressly left undecided.

What were the facts?

The assessee, Shri Mohamed Yusuf Sadik Basha, filed an appeal before the Commissioner of Income Tax (Appeals) - National Faceless Appeal Centre (NFAC), Delhi, for the Assessment Year 2018-19. The First Appellate Authority (FAA) dismissed the appeal in limine due to a delay of 36 days in filing. The FAA rejected the assessee's request for condonation of delay, finding that the reasons provided – the authorised representative being occupied with arrangements for his son's marriage and nephew's betrothal – did not constitute a reasonable cause. The assessee's authorized representative stated the delay was 39 days due to arrangements for his son's marriage.

What were the issues?

1. Whether the delay of 36/39 days in filing the appeal before the First Appellate Authority (FAA) is liable to be condoned under Section 250 of the Income Tax Act, 1961, on the grounds cited by the assessee? Assessee's Contention: The assessee argued that the delay in filing the appeal was due to the authorized representative being occupied with arrangements for his son's marriage and nephew's betrothal. The assessee pleaded for condonation of the delay, attributing it to these circumstances faced by the authorized representative. Revenue's Contention: The Revenue supported the order of the FAA, which had rejected the condonation of delay.

आदेश/ O R D E R PER GEORGE GEORGE K, VICE PRESIDENT: This appeal filed by the assessee is directed against the order of the Commissioner of Income Tax (Appeals), National Faceless Appeal Centre (NFAC), Delhi dated 20.07.2026, passed under section 250 of the Income Tax Act, 1961 (hereinafter called ‘the Act’). The relevant Assessment Year is 2018-19.

- 2 - ITA No.4358/CHNY/2026 Mohamed Yusuf Sadik Basha 2. At the very outset, we notice that the First Appellate Authority (FAA) had dismissed the appeal of the assessee in limine without adjudicating on merits. The FAA held that there is a delay of 36 days in filing this appeal before him and there is no reasonable cause for condoning the same.

3.

On perusal of the order of the FAA, we note that the assessee had sought condonation of the delay of 36 days in filing the appeal, stating that its authorised representative was occupied with arrangements for his son’s marriage and his nephew’s betrothal during the relevant period. The FAA, however, rejected the request for condonation of delay, holding that the reasons cited did not constitute reasonable cause, and consequently dismissed the appeal in limine.

4.

The Ld. AR submitted that the delay of 39 days in filing the appeal occurred as the assessee’s authorised representative was occupied with arrangements for his son’s marriage during the relevant period. Consequently, the appeal could not be filed within the prescribed time. The Ld. AR submitted that the delay was attributable to the circumstances faced by the authorised representative and, therefore, pleaded for condonation of the delay.

- 3 - ITA No.4358/CHNY/2026 Mohamed Yusuf Sadik Basha 5. The Ld.DR supported the order of the FAA.

6.

We have heard the rival submissions and perused the material available on record. The delay of 39 days in filing the appeal before the FAA is stated to have occurred due to the authorised representative being occupied with arrangements for his son’s marriage during the relevant period. Considering the reasons advanced and in the interest of justice and fair play, we deem it appropriate to condone the delay of 39 days and restore the matter to the file of the FAA for adjudication on merits, after affording the assessee a reasonable opportunity of being heard. The assessee is directed to extend full co-operation and shall not seek unnecessary adjournments. It is ordered accordingly.

7.

In the result, the appeal filed by the assessee is allowed for statistical purposes.
