DINESH CHANDRA YADAV,SAHARSA vs. INCOME TAX OFFICER WARD 3(4) SAHARSA, GAUTAM NAGAR KOSHI CHOWK SAHARSA
What did the Tribunal hold?
The Tribunal noted that the assessee's case was reopened under Section 147/148 for assessing escaped income. A notice was issued on March 27, 2021, and the assessee filed the return on May 26, 2021, which was beyond the 30-day period granted. Consequently, the AO was not bound to provide all information as argued by the assessee's counsel. The Tribunal also observed that the assessee raised a legal issue for the first time before the ITAT, having not represented their case before the Ld. CIT(A), leading to an ex-parte order. Considering the rival submissions, the prayer of the assessee's counsel, the facts, and the interest of justice, the Tribunal decided to remit the issue back to the file of the AO for fresh consideration and decision. The assessee was directed to submit supporting documents and not seek unnecessary adjournments. The case was partly allowed for statistical purposes.
What were the facts?
The assessee, Dinesh Chandra Yadav, an individual and Member of Parliament, filed his Income Tax Return (ITR) for Assessment Year (AY) 2016-17 on March 31, 2017, declaring a total income of Rs. 11,22,010. A notice under Section 148 of the Income Tax Act, 1961, was issued on March 27, 2021, alleging escapement of income due to the purchase of three immovable properties for Rs. 60,92,752. The assessee filed a revised ITR on May 26, 2021, declaring the same income. The Assessing Officer (AO) made additions of Rs. 21,66,208 on account of unexplained investment and Rs. 7,50,983 for excess stamp value, assessing the total income at Rs. 40,39,204. The assessee appealed to the National Faceless Appeal Centre (NFAC), Delhi, which dismissed the appeal ex-parte for non-compliance. The assessee then appealed to the Income Tax Appellate Tribunal (ITAT).
What were the issues?
1. Whether the reopening of assessment under Section 147 of the Income Tax Act, 1961, is valid, considering the alleged purchase of three properties was factually incorrect, with the assessee claiming to have purchased only two properties, and whether the AO applied his mind independently. (Assessee's contention: Reopening is invalid due to incorrect facts and non-application of mind by the AO. The reasons recorded were not supplied initially. The AO proceeded on wrong facts, and the foundation of reopening, i.e., alleged purchase of three properties, is factually incorrect. Revenue's contention: The notice was issued on 27.03.2021, granting 30 days for filing the return. The assessee filed it on 26.05.2021, beyond the stipulated time, thus ceasing their right to receive a copy of the reasons recorded. The AO was not bound to provide reasons as per CIT vs. Kelvinator of India Ltd. (SC).) 2. Whether the addition of Rs. 21,66,208 under Section 69 and Rs. 7,50,986 under Section 56(2)(vii)(b) is sustainable, given the alleged incorrect property assumption and lack of proper inquiry. (Assessee's contention: Addition is based on incorrect property assumption, no unexplained investment exists, and it was made without proper inquiry. Addition under Section 56(2)(vii)(b) was beyond recorded reasons and without proper verification of stamp value. Revenue's contention: Relied on lower authorities' orders.) 3. Whether the dismissal of the appeal by the Ld. CIT(A) was illegal and ex-parte, violating principles of natural justice. (Assessee's contention: The appellate authority erred in dismissing the appeal without adjudicating grounds on merits, violating principles of natural justice. Revenue's contention: Assessee disrespected notices issued by the Ld. CIT(A).)

This is an appeal filed by the assessee against the order passed by the NFAC, Delhi (hereinafter referred to as) the Ld. CIT(A)
dated 12.01.2026 for order no. ITBA/NFAC/S/250/2025-
26/1084675200(1) u/s 147 of the Income Tax Act u/s 250 of the
Acton the following grounds of appeal:-
The appellant being an Individual and Member of parliament(MP) regularly assessed to income tax filed ITR for the Assessment Year 2016-17 on 31.03.2017 on total income of Rs 1122010/- 2. That a Notice under Section 148 dated 27/03/2021 was issued the appellant filed ITR in response to notice under section 148 on 26/05/2021 on total income of Rs. 1122010/-, however "Reason recorded for issuance of Notice u/s 148 was not issued /served to the appellant. 3. That The appellant filed ITR in response to notice on account of cash deposits of Rs. 51,08,000/- in the bank account during FY 2014-15. 4. That The notice issued u/s 148 dated 27.03.2021 is bad in law as Reasons were not supplied initially. 5. That Invalid Reopening u/s 148, Reopening is based on incorrect facts and without having inaccurate information or without conducting enquiry Notice 148 was issued alleging purchase of 3 properties, factual position is that only 2 properties was purchased by the appellant No valid "reason to believe" exists. 6. That The Learned AO proceeded on wrong facts, hence reopening is invalid as the reopening was made by Non application of mind. Since the very foundation of reopening i.e. alleged purchase of three properties is factually incorrect, the reason to believe is vitiated and the assumption of jurisdiction u/s 147 deserves to be quashed." 7. That Invalid Sanction u/s 151 was obtained by the JCIT is mechanical and invalid since Based on incorrect income of Rs. 60,92,752/- and No independent satisfaction recorded. 8. That Addition in total income of the appellant was made beyond recorded reasons, the AO made addition of Rs. 21,66,208 instead of Rs. 60,92,752.00 which shows lack of nexus between reasons and addition. 9. That on the facts and in the circumstances of the case, the reopening of assessment under section 147 is bad in law as the 'reason to believe recorded by the Assessing Officer is based on incorrect and non-existent facts, namely alleged purchase of three immovable properties aggregating to Rs. 60,92,752/-, whereas the appellant had in fact purchased only two properties aggregating to Rs. 27,64,631/-. Hence, the assumption of jurisdiction u/s 147 is invalid and liable to be quashed." 10. That No unexplained investment as the AO failed to verify Sale deeds Payment source prior to passing assessment order.
That Addition u/s 69 of Rs. 21,66,208.00 is based on incorrect property assumption, No unexplained investment exists, addition was made without conducted proper inquiry, hence addition of Rs 2166208/- can not sustained. 12 That Addition u/s 56(2)(vii)(b) Rs. 7,50,986 was made beyond reason recorded, without proper verification of Stamp value adopted without referring for valuation 13. That, Illegal ex-parte dismissal of appeal the Learned CIT(A) erred in dismissing appeal without adjudicating the grounds raised by the assessee on merits. 14. That It is a settled principle of law that the appellate authority is required to dispose of the appeal on merits, even in cases of non-compliance the action of the Ld CIT Violates principles of natural justice 15. That the appellant craves leave to add, alter, amend or withdraw any ground of appeal at or before the time of hearing. 2. Briefly stated that the facts of the case are that the assessee filed his return of income on 31.03.2017 declaring at income of Rs. 11,22,010/-. The assessee had declared income from other source of Rs. 12,82,012/- it was notice that during the year under consideration the assessee has purchased three immovable properties for total consideration of Rs. 60,92,752/-. Accordingly, the case of the assessee was re-opened after following due procedure for assessing the escaped income u/s 147/148 and duly approval was taken u/s 151 of the Act. The assessee filed return of income on 26.05.2021 in response to the notice u/s 148 dated 27.03.2021. The reason for the reopening is quoted in the assessment order. The notice u/s 143(2) and other statutory notices were issued to the assessee time to time and finally a show cause notice was also issued to the assessee to complete the assessment
u/s 144 of the Act in response to the show cause notice the assessee filed reply on 14.02.2022. The assessing officer considering the reply of the assessee he noted that there is an unexplained investment of Rs. 21,66,208/- and addition on account of excess of stamp value for Rs. 7,50,983/- accordingly the total income of assessee was assessed at Rs. 40,39,204.
Aggrieved from the above order the assessee filed appeal before the Ld. CIT(A).
During the course of first appellate proceedings the Ld. CIT(A) issued various notices which is clear from the para No. 5.2 of this order which is under:-
5.2 I have gone through the materialistic facts of the case and contention of the appellant. During the course of appellate proceedings, the appellant has furnished the statement of facts and form no. 35 which has been taken on record. It is found that the appellant has not submitted anything concrete in his support. During the appellant proceedings, the undersigned has issued notices u/s 250 of the Act to the appellant on 06/06/2025, 27/11/2025, 08/12/2025 & 22 12.2025 In this case, the appellant was given several opportunities to make submissions during appeal proceedings by issue of notices u/s 250 as mentioned above. However, the appellant did not bother to file submission to these statutory notices issued by the undersigned. 5.3 I have carefully considered the Order passed on 22/03/2022 under section 147 r.w.s. 144B of the IT Act for the A.Y. 2016-17, the grounds of appeal preferred by the appellant and the statement of facts. In this case, appellant was given several opportunities to make submissions during appeal proceedings by issue of notices u/s 250 as mentioned in above para. However, the appellant did not bother to file submission of these statutory notices issued by the undersigned along with supporting documents.
For want of representation from the assessee side, the Ld. CIT(A) decided the issue of materials available before him and dismiss the appeal of the assessee.
Aggrieved from the above order the assessee filed appeal before ITAT raising the above grounds.
The Ld Counsel submitted that re-opening the case of the assessee is not as per the provisions for assessing the escaped income in the line of Section 147 to 151 of the Act and further submitted that the re-opening of the case of the assessee is invalid and AO has not applied his mind. The Assessing Officer has noted that the assessee has purchased three properties, however, the assessee purchased a two properties only and the Assessing Officer has also not provided the copy of reasons recorded to the assessee. He further submitted that during the course of first appellate proceedings the assessee could not respond the notices issued by the Ld. CIT(A). He further requested and undertook that if one more chance is given to the assessee, the assessee will be able to demonstrate that there is no escapement of income.
On the other hand the Ld. DR relied on the order of lower authorities further submitted that the notice was issued to the assessee on 21.03.2021 and 30 days time was granted to assessee for filing return of income. However, the assessee filed return of income beyond 30 days i.e. 26.05.2021 therefore the legal rights of the assessee ceased to exist for taking copy of reasons recorded . The AO was not bound for providing copy of reasons recorded to the assessee as per the judgment relied by the Ld. Counsel of the Hon'ble Apex Court in the case of CIT vs Kelvinator of India Ltd. reported in [2010] 187 Taxman 312 (SC) .He requested that the order of lower authorities should be upheld and the assessee has disrespected the notices issued by the Ld. CIT(A).
Considering the rival submissions perusing the entire materials available on record and order of authorities below we noted that the case of the assessee has been reopened to assessee the escaped income as per section 147/148 of the act and assessee was issued notice on 27.03.2021 in response to the assessee filed return of income on 26.05.2021 which is beyond 30 days of the time granted to the assessee to file return of income. Accordingly,
the AO was not bound to provide all information as the issue raised by the assessee counsel. We also noted from the grounds of appeal that the assessee has raised a first time legal issue before us and the before Ld. CIT(A) the assessee did not represent his case. Accordingly the Ld. CIT(A) passed an ex-parte order. Considering the facts of the case prayer of the assessee counsel, facts of the case and the interest of justice we are remitting this issue back to the file of the AO for fresh consideration and decision as per law after giving reasonable opportunity of being heard to the assessee and assessee is directed to submit/ present documents in support of his claim and not seek unnecessary adjournment for early disposal of the case in case of failure no second leniency shall granted to the assessee.
The case of the assessee is partly allowed for statistical purpose.
