ABHEESHT GOEL,DELHI vs. DEPUTY COMMISSIONER OF INCOME TAX CENTRAL CIRCLE 28, DELHI
What did the Tribunal hold?
The Tribunal held that the assessment order deserves to be quashed on jurisdictional grounds. The Tribunal reasoned that if a search is conducted or a satisfaction is recorded after April 1, 2021, then a notice is to be issued under Section 148 of the Act after obtaining approval from the competent authority, and the assessment is to be completed under Section 147 of the Act. Since, in this case, the notices and assessment were completed under Section 153C of the Act, despite the satisfaction being recorded after April 1, 2021, the assessment proceedings were held to be invalid. Consequently, the assessee's appeal on this jurisdictional ground was allowed. The Tribunal, having decided the jurisdictional issue in favor of the assessee, stated that it was not inclined to decide on the other grounds of appeal on merit.
What were the facts?
The assessee, Abheest Goel, filed an appeal against the order dated 23.02.2026 passed by the CIT(A)-25, Delhi, for Assessment Year 2014-15. The appeal challenges additions made under various sections of the Income Tax Act, including Rs. 30,00,000 under Section 69A for alleged cash received, Rs. 71,12,083 under Section 69A for alleged bogus share trading, Rs. 3,91,164 under Section 69C for alleged commission on bogus share trading, Rs. 60,00,000 under Section 68 for alleged unsecured loan, Rs. 1,80,000 under Section 69C for alleged commission on unaccounted transactions, Rs. 35,000 under Section 69C for alleged cash paid on unsecured loan, and Rs. 35,000 under Section 69A for alleged interest received on unsecured loan. The primary argument raised by the assessee's counsel concerned the jurisdictional issue related to the assessment proceedings initiated under Section 153C.
What were the issues?
1. Whether the assessment proceedings initiated under Section 153C of the Income Tax Act, 1961, are valid when the satisfaction for search was recorded after April 1, 2021, and the amended provisions of Section 148 and Section 153C are applicable? Assessee's Contention: The assessee argued that a search and seizure operation under Section 132 was conducted on M/s. Alankit Group on 18.10.2019. Subsequently, a notice under Section 153C was issued on 15.11.2022. The assessee contended that as per the amended provisions of the Income Tax Act, effective from April 1, 2021, search-related cases are to be dealt with under Section 148, and Section 153C(3) does not apply to searches initiated on or after April 1, 2021. Since the satisfaction for the searched person was recorded on June 20, 2022, the assessment should have been completed under Section 147, with a notice issued under Section 148 after obtaining approval from the competent authority. Revenue's Contention: The Revenue relied on the orders of the authorities below.
Which sections of the Income-tax Act were involved?
Section 132,Section 143(2),Section 147,Section 148,Section 153C,Section 250,Section 68,Section 69A,Section 69C

Further a notice u/s.143(2) of the Act was also issued alongwith questionnaire and the assessment was completed on 07.03.2024 u/s.153C of the Act. The ld.
