RAJESWARI JAYAKUMAR ALYA MANASA,CHENNAI vs. ASSESSMENT UNIT, INCOME TAX DEPARTMENT
What did the Tribunal hold?
The Tribunal acknowledged the assessee's failure to respond to statutory notices, strongly deprecating the nonchalant attitude. However, considering the submissions of the authorized representative and in the interest of justice and fair play, the Tribunal decided to restore the matter to the file of the Assessing Officer (AO) for fresh adjudication. The AO was directed to provide a reasonable opportunity of hearing to the assessee. The assessee was directed to cooperate with the Revenue and avoid seeking unnecessary adjournments. The Stay Application was dismissed as infructuous since the appeal was disposed of. The Tribunal allowed the appeal for statistical purposes.
What were the facts?
The assessee, Rajeswari Jeyakumar Alya, a film artist, filed an appeal against the order of the Commissioner of Income Tax (Appeals), National Faceless Appeal Centre (NFAC), Delhi, for Assessment Year 2024-25. The appeal was decided ex-parte by the First Appellate Authority (FAA) due to the assessee's non-compliance with three notices issued on 01.06.2026, 07.07.2026, and 24.07.2026. The assessee's authorized representative submitted that these notices were sent to the email ID of an erstwhile auditor, which had not been updated, leading to the assessee's unawareness of the appellate proceedings. The assessee also claimed that the audit report and financial statements submitted to the Assessing Officer (AO) were not considered.
What were the issues?
1. Whether the assessee was denied a fair opportunity to present her case before the First Appellate Authority, thereby violating principles of natural justice, in light of the ex-parte order passed due to non-receipt of notices? (Question of mixed law and fact, concerning Section 250 of the Income Tax Act, 1961). Assessee's contentions: The assessee argued that the ex-parte order was a result of notices being sent to an outdated email address of her former auditor, making her unaware of the proceedings. She contended that her audit report and financial statements were not considered by the AO. Therefore, she requested one more opportunity to present her case. Revenue's contentions: The Revenue argued that adequate opportunities were provided by the FAA and that there was no violation of the principles of natural justice. They prayed for the dismissal of the assessee's appeal.

आदेश/ O R D E R PER GEORGE GEORGE K, VICE PRESIDENT: This appeal filed by the assessee is directed against the order of the Commissioner of Income Tax (Appeals), National Faceless Appeal
:- 2 -: ITA No.4910/Chny/2026 & SA No.175/Chny/2026 Centre (NFAC), Delhi, dated 10.08.2026 passed under section 250 of the Income Tax Act, 1961 (hereinafter called ‘the Act’). The relevant Assessment Year is 2024-25.
At the very outset, we notice that the order passed by the First Appellate Authority (FAA) is ex-parte, since there was no compliance from the assessee to three notices issued from the office of the First Appellate Authority.
The Ld. AR submitted that the assessee is a film artist and was frequently occupied with shooting schedules. Therefore, failed to take note of the notices of hearing issued by the FAA on 01.06.2026, 07.07.2026 and 24.07.2026. It was further submitted that the notices were sent to the email ID of the assessee’s erstwhile auditor, which had not been updated, as a result of which the assessee’s authorized representative remained unaware of the appellate proceedings and could not represent her case before the FAA. The Ld. AR further contended that the audit report and financial statements furnished before the AO during the assessment proceedings had not been duly considered. Accordingly, the Ld. AR pleaded that, in the interest of justice and fair play, one more opportunity may be granted to the assessee to substantiate her case before the AO.
:- 3 -: ITA No.4910/Chny/2026 & SA No.175/Chny/2026 4. The Ld.DR submitted that adequate opportunities were provided from the offices of the FAA and there is no violation of principles of natural justice. Therefore, it was prayed the appeal of the assessee may be dismissed.
We have heard the rival submissions and perused the material available on record. The Ld. AR submitted that the FAA had issued three notices of hearing on 01.06.2026, 07.07.2026 and 24.07.2026, which the assessee had failed to take note of, resulting in the appellate proceedings being concluded ex-parte. The Ld. AR further submitted that the assessee had filed the audit report and financial statements before the AO through the e-portal, but the same had not been taken into consideration. She, therefore, pleaded that one more opportunity may be granted to the assessee to substantiate her case before the AO and undertook that the assessee would duly appear and furnish all necessary details and evidences as and when called for. We strongly deprecate the nonchalant attitude of the assessee in failing to respond to the statutory notices issued by the FAA. Nevertheless, considering the submissions of the Ld. AR and in the interest of justice and fair play, we deem it appropriate to restore the matter to the file of the AO for fresh adjudication in accordance with law. The AO shall afford reasonable opportunity of hearing to the assessee. The assessee is

SA No.175/CHNY/2026 6. Since we have disposed off the appeal of the assessee, the Stay application is rendered infructuous and is dismissed.
