COMMR.OF INCOME TAX vs. N.C.KALADHARAN,TVM
What did the High Court hold?
The High Court held that the issue is covered by the Supreme Court's decision in Commissioner of Income Tax v. Govinda Choudhurg and Sons (203 ITR 881). In that case, the Supreme Court held that both the compensation and the interest awarded should be treated as contract receipts. Therefore, the estimation of income at 10% would apply to the interest element as well. The Revenue's reliance on United Construction Contractors v. Commissioner of Income Tax was deemed not applicable in light of the Supreme Court's ruling. The appeal filed by the department was dismissed.
What were the facts?
The appeal concerns the assessment year 1993-94. The assessee, Mr. N. Chellappan, was awarded a contract by the Kerala State Electricity Board in 1966, which was cancelled in 1970. Following litigation, an award for work done and interest was passed. The assessee died during the proceedings, and the appeal is now represented by his son. The Commissioner of Income Tax (Appeals) estimated the income at 10%, a decision confirmed by the Income Tax Appellate Tribunal. The Revenue is challenging this confirmation, specifically regarding the applicability of the 10% estimation to the interest component of the award.
What were the issues?
1. Whether the estimation of income at 10%, as fixed by the Commissioner of Income Tax (Appeals) and confirmed by the Tribunal, applies to the interest element of the award amount. Assessee's Contention: Not explicitly recorded, but impliedly supports the Tribunal's decision to apply the 10% estimation to the interest. Revenue's Contention: Argued that interest is entirely taxable as it is an addition to the contract amount. Relied on the decision in United Construction Contractors v. Commissioner of Income Tax (1994 (1) KLT 880).

We have heard learned Standing Counsel appearing for the department and learned counsel for the respondent.
The question raised is whether the estimation of income at 10% as fixed by the Commissioner of Income Tax (Appeals) and confirmed by the Tribunal applies to interest element of the award amount. According to the Revenue, interest is entirely taxable as it is an addition to the contract amount. However, we find that the issue is covered by the decision of the Supreme Court in Commissioner of Income Tax v. Govinda Choudhurg and Sons (203 ITR 881) wherein the Supreme Court held that the compensation as well as interest have to be treated as contract receipts. Since the issue raised is covered by the decision of the Supreme Court, we do not think there is any scope for considering the decision relied on by the learned counsel for the Revenue in United Construction Contractors v. Commissioner of Income Tax (1994 (1) KLT 880).
The appeal is therefore dismissed. (C.N. Ramachandran Nair, Judge.) (T.R. Ramachandran Nair, Judge.) kav/ -3- C.N. Ramachandran Nair & & T.R.
