What did the High Court hold?

The High Court held that the reassessments were time-barred for all assessment years except 1989-90. The Court did not delve into the merits of the cases concerning the taxability of interest on enhanced compensation, citing the low tax amounts involved. The Court noted the Department's current norms of not filing appeals to the High Court when the tax amount is below the threshold limit prescribed by the CBDT. Consequently, all the appeals were dismissed.

What were the facts?

The appeals involve the Commissioner of Income Tax, Kottayam (Revenue) challenging orders of the Income Tax Appellate Tribunal (Tribunal) concerning reassessments made under Section 147 of the Income Tax Act, 1961. The respondent is Chacko Thomas. The assessment years range from 1983-84 to 1989-90. The core dispute revolves around whether the reassessments were time-barred and, alternatively, whether interest awarded on enhanced compensation for acquired agricultural land (outside urban areas) constitutes capital gains exempt from tax. The High Court noted that the tax amounts involved were below one lakh rupees.

What were the issues?

1. Whether the Tribunal was justified in cancelling reassessments made under Section 147 of the Income Tax Act, 1961, as time-barred? (Question of law) 2. Whether the interest awarded by the Land Acquisition Court on enhanced compensation for acquired agricultural land outside urban areas constitutes capital gains exempt from tax in this case? (Question of mixed law and fact) Assessee's Contentions: The assessee argued that the reassessments were time-barred. The assessee also contended that the interest awarded on enhanced compensation for agricultural land acquired outside urban areas should be treated as exempt capital gains. Revenue's Contentions: The Revenue contended that the reassessments were validly made. The Revenue also argued that the interest awarded on enhanced compensation should be treated as taxable capital gains.

Which sections of the Income-tax Act were involved?

2.

In these batch cases, the question raised by the appellant is whether the Tribunal was justified in cancelling the reassessment made under section 147 of the I.T.Act as time barred. The alternate question raised is whether the interest awarded by the Land Acquisition court in the enhanced compensation granted forms capital gain which is exempt in this case because the land acquired is agricultural land outside the urban area. We notice that the cases pertain to the year 1983-84 to 1989-90. The Tribunal rightly held that the reassessments are barred by limitation except for 1989-

90.

We do not propose to go into the merits of these cases where the tax amount involved is below one lakh rupees. The current norms of the Department is not to file appeal to High Court where the amount of tax involved is less than the threshold limit prescribed by the CBDT. We therefore dismiss all these appeals. C.N.RAMACHANDRAN NAIR JUDGE
