SONY JOSEPH vs. ASSESSMENT UNIT, ADDITIONAL/JOINT/DEPUTY/ ASSISTANT COMMISSIONER OF INCOME TAX/INCOME TAX OFFICER
What did the High Court hold?
The High Court directed the second respondent, the Commissioner of Income Tax (Appeals), to consider and dispose of the petitioner's stay petition (Ext.P3) in accordance with law and as expeditiously as possible, within a period of three months from the date of receipt of a certified copy of the judgment. The petitioner is to be afforded an opportunity of being heard. The court also stipulated that if a conditional order of stay is proposed, the reasons for it must be stated. Crucially, until orders are passed on the stay petition, all further proceedings pursuant to the assessment order (Ext.P1) are to stand deferred. The court did not decide on the merits of the assessment order or the appeal itself, focusing solely on the procedural aspect of the pending stay petition.
What were the facts?
The petitioner, Sony Joseph, filed a writ petition before the High Court of Kerala seeking a direction to the second respondent, the Commissioner of Income Tax (Appeals), to expeditiously consider and dispose of his appeal (Ext.P2) and stay petition (Ext.P3). The petitioner was aggrieved by an assessment order (Ext.P1) and had filed the appeal on October 21, 2022, followed by a stay petition on May 18, 2023. The petitioner apprehended that the respondents might enforce the assessment order during the pendency of the stay petition. The respondents were represented by their counsel.
What were the issues?
