DR. N UTHAMAN, vs. THE INCOME TAX OFFICER,
What did the High Court hold?
The High Court of Kerala, considering the submissions made on behalf of the respondents, directed the petitioner to file a physical copy of his rectification application before the 1st respondent within ten days from the date of the order. The Court further directed that this application shall be considered and an order in accordance with law shall be passed by the 1st respondent expeditiously. Pending the decision on the rectification application by the 1st respondent, all proceedings pursuant to the demand notice (Exhibit P-3) were ordered to be kept in abeyance. The writ petition was disposed of with these directions. No specific issue regarding the merits of the rectification itself was decided, as the focus was on procedural compliance and ensuring consideration of the application.
What were the facts?
The petitioner, Dr. N Uthaman, filed his income tax return for Assessment Year (AY) 2018-19 on July 17, 2018. He received an intimation under Section 143(1) of the Income Tax Act from the 2nd respondent (Deputy Commissioner of Income Tax, Centralised Processing Centre, Bengaluru) on November 20, 2018. Subsequently, on January 15, 2019, the petitioner filed a rectification application under Section 154 of the Act with the 2nd respondent, supported by an e-filing acknowledgment. The petitioner approached the High Court of Kerala seeking a writ of mandamus to direct the 2nd respondent to consider his rectification request and to restrain the respondents from enforcing demand proceedings pursuant to the Section 143(1) intimation.
What were the issues?
1. Whether the 2nd respondent should be directed to consider the petitioner's rectification request dated January 15, 2019, for AY 2018-19, and pass an order thereon after affording a hearing, as per the petitioner's prayer for a Writ of Mandamus under Article 226 of the Constitution of India. Assessee's Contention: The petitioner argued that his rectification application filed on January 15, 2019, has not been decided to date, and sought a direction for its consideration. Revenue's Contention: The learned Standing Counsel for the respondents submitted that the Centralised Processing Centre in Bengaluru does not have a record of the rectification application, and the website does not show any pending application. However, the revenue offered that if the petitioner files the application physically before the 1st respondent (Income Tax Officer) within ten days, it would be considered irrespective of the expired limitation period.
