What did the High Court hold?

The High Court dismissed ITA No. 21 of 2011 based on the Revenue's litigation policy. The Court observed that the appeal's subject matter was less than Rupees Fifty Lakhs, aligning it with other appeals that were withdrawn by the Revenue due to the same policy. Consequently, the Court found no reason to adjudicate on this particular appeal. However, the Court explicitly stated that the question of law would be considered in ITA No. 19 of 2011, where the tax effect exceeded Rupees Fifty Lakhs. The parties were directed to bear their respective costs. No issue was expressly left undecided, as the appeal was dismissed on procedural grounds.

What were the facts?

The appeal concerns a block assessment initiated by a search under Section 132 of the Income Tax Act, 1961, conducted on March 2, 2000, across group concerns of the Orma Group. The search led to block assessments for four entities: Orma Marble Palace, New Orma Marble Palace, Orma Marble Palace Pvt. Ltd., and Orma Granite Palace. The Commissioner of Income Tax-II, Cochin, filed appeals against all four assessees. Two of these appeals, ITA Nos. 13 of 2011 and 29 of 2011, were withdrawn by the Revenue based on its litigation policy. The present appeal, ITA No. 21 of 2011, involves a subject matter less than Rupees Fifty Lakhs, placing it in a similar category to the withdrawn appeals.

What were the issues?

1. Whether the High Court should adjudicate on ITA No. 21 of 2011, given the Revenue's litigation policy and the amount in dispute. The Revenue, represented by its counsel, argued that the appeal arises from a block assessment following a search. The Revenue's litigation policy restricts prosecution of appeals where the tax effect is less than Rupees Fifty Lakhs. The present appeal falls under this category. The Revenue also noted that connected matters with similar subject matter were withdrawn based on this policy. The judgment does not record any specific arguments from the assessee, Orma Granite Palace.

BY ADVS. SRI.P.K.R.MENON, SENIOR COUNSEL, GOI (TAXES) SRI.JOSE JOSEPH, SC FOR INCOME TAX RESPONDENT: ORMA GRANITE PALACE, ANGAMALY SOUTH, ANGAMALY-683 573. BY ADVS. SRI.N.RAGHURAJ SRI.JOSEPH MARKOSE (SR.) THIS INCOME TAX APPEAL HAVING BEEN FINALLY HEARD ON 17.12.2018, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: ITA.No.21 of 2011 - 2 -

JUDGMENT Vinod Chandran,J.

The appeal arises from a block assessment made pursuant to a search conducted in the premises of the group concerns on 02.03.2000. The very same action under Section 132 of the Income Tax Act, 1961 has resulted in block assessment with respect to four different assessees, viz., Orma Marble Palace, New Orma Marble Palace, Orma Marble Palace Pvt. Ltd. and Orma Granite Palace; all of whom are said to be comprised under the Orma Group of concerns. Appeals have been filed by the Revenue as against all the individual assessees and two of them [I.T.A.Nos.13 of 2011 and 29 of 2011] have been withdrawn based on the litigation policy. We find that the present appeal [I.T.A.No.21 of 2011] also is similarly situated insofar as the subject matter of appeal being less than Rupees Fifty lakhs. In such circumstances, we do not find any reason to adjudicate upon I.T.A.No.21 of 2011, since the litigation policy restricts the Revenue from prosecuting the same and the connected matters were also withdrawn by the Revenue based on the litigation policy. In the above circumstances I.T.A.No.21 of 2011 is dismissed based on the litigation policy; but, however, leaving the question of law to be considered in I.T.A.No.19 of 2011, in which the tax effect would be more than Rupees Fifty Lakhs. Parties are left to suffer their respective costs. K.VINOD CHANDRAN JUDGE ASHOK MENON JUDGE - 4 -
