COMMISSIONER OF WEALTH-TAX vs. SAHYADRI ASSOCIATES
What did the High Court hold?
The High Court of Gujarat, in its judgment delivered by R.K. Abichandani, J., answered the question referred to it in the affirmative, in favour of the assessee and against the Revenue. The Court stated that the facts and the question involved were similar to those in Wealth Tax Reference No. 43/93, which had also been decided on the same day. For the reasons provided in the judgment of Wealth Tax Reference No. 43/93, the High Court upheld the ITAT's decision. The ratio decidendi is that the ITAT's direction to charge wealth tax at the normal rate, as opposed to the maximum marginal rate, was legally and factually correct. The reference was disposed of accordingly, with no order as to costs. The operative direction was to uphold the ITAT's order, implying the Assessing Officer should charge tax at the normal rate.
What were the facts?
This case involves a reference made by the Income Tax Appellate Tribunal (ITAT), Ahmedabad, to the High Court of Gujarat concerning the Wealth Tax Act, 1957. The reference pertains to the assessment year(s) not explicitly stated but implied to be similar to Wealth Tax Reference No. 43/93. The dispute centers on the rate of wealth tax to be charged. The Wealth Officer (WTO) charged tax at the maximum marginal rate of 3%, whereas the assessee, Sahyadri Associates, contended for the normal rate. The ITAT directed the Assessing Officer to charge tax at the normal rate, leading to this reference by the Commissioner of Wealth-tax.
What were the issues?
1. Whether the Appellate Tribunal is right in law and on facts in directing the Assessing Officer to charge wealth tax at the normal rate as against the maximum marginal rate of 3% charged by the WTO? (Question of law and fact, concerning the interpretation and application of the Wealth Tax Act, 1957). Assessee's Contentions: The assessee argued that the wealth tax should be charged at the normal rate. The judgment does not explicitly detail the assessee's arguments or any specific authorities or precedents relied upon, but it implies their position was accepted by the Tribunal. Revenue's Contentions: The Revenue, through the Commissioner of Wealth-tax, challenged the ITAT's direction to charge tax at the normal rate, preferring the maximum marginal rate of 3% charged by the WTO. The judgment does not explicitly detail the Revenue's arguments or any specific authorities or precedents relied upon, other than the WTO's initial action.

ORAL JUDGEMENT (Per R.K.Abichandani,J.)
The Income Tax Appellate Tribunal, Ahmedabad has referred for the opinion of this Court the following question under Section 27(1) of the Wealth Tax Act, 1957. "Whether the Appellate Tribunal is right in law and on facts in directing the Assessing Officer to charge rate at normal rate as against the maximum marginal rate of 3% charged by the WTO?"
A similar question has been answered by us today in Wealth Tax Reference No. 43/93. Since the facts are similar and the question involved almost identical, we do not find it necessary to reproduce the facts of this case. For the reasons given by us in our judgement and order delivered in Wealth Tax Reference No. 43/93 today, we answer the question referred to us in the affirmative in favour of the assessee and against the Revenue. The reference stands disposed of accordingly with no order as to costs.
