What did the High Court hold?

The High Court held that the Appellate Tribunal was right in law and on facts in directing the Assessing Officer to levy tax at the normal rate when the net wealth disclosed was below the taxable limit. The reasoning provided is that the High Court, in a similar case (Wealth Tax Reference No. 43/93) decided on the same day, had answered an almost identical question in favour of the assessee and against the Revenue. The principle derived from the concurrent judgment is that if the net wealth is below the taxable limit, tax should not be levied at the normal rate. The operative direction is that the question referred to the High Court is answered in the affirmative, in favour of the assessee and against the Revenue. The reference stands disposed of accordingly, with no order as to costs. No issue was expressly left undecided.

What were the facts?

This case involves a reference made by the Income Tax Appellate Tribunal (ITAT), Ahmedabad, to the High Court of Gujarat concerning the Wealth Tax Act, 1957. The reference pertains to Assessment Year(s) not explicitly stated. The order or action under challenge is the ITAT's direction to the Assessing Officer to levy tax at the normal rate, despite the net wealth disclosed being below the taxable limit. The procedural history indicates that the High Court is being asked to provide its opinion on a question of law and fact referred by the ITAT under Section 27(1) of the Wealth Tax Act. The amount in dispute is not specified. The High Court notes that the facts are similar to another case, Wealth Tax Reference No. 43/93, decided concurrently.

What were the issues?

1. Whether the Appellate Tribunal is right in law and on facts in directing the Assessing Officer to levy tax at the normal rate when the net wealth disclosed was below the taxable limit? (Question of law and fact, concerning the levy of wealth tax under the Wealth Tax Act, 1957). Assessee's Contentions: The judgment does not record any specific contentions made by the assessee (Sagar Sarav Trust) before the High Court. However, the question referred implies that the assessee likely argued that tax should not be levied if the net wealth is below the taxable limit. Revenue's Contentions: The judgment does not record any specific contentions made by the Revenue (Commissioner of Wealth Tax) before the High Court. However, the question referred implies that the Revenue likely argued for the levy of tax at the normal rate even when net wealth is below the taxable limit, or that the Tribunal's direction was incorrect.

ORAL JUDGEMENT (Per R.K.Abichandani,J.)

The Income Tax Appellate Tribunal, Ahmedabad has referred for the opinion of this Court the following question under Section 27(1) of the Wealth Tax Act, 1957. "Whether the Appellate Tribunal is right in law and on facts in directing the Assessing Officer to levy tax at the normal rate when the net wealth disclosed was below the taxable limit?"

A similar question has been answered by us today in Wealth Tax Reference No. 43/93. Since the facts are similar and the question involved almost identical, we do not find it necessary to reproduce the facts of this case. For the reasons given by us in our judgement and order delivered in Wealth Tax Reference No. 43/93 today, we answer the question referred to us in the affirmative in favour of the assessee and against the Revenue. The reference stands disposed of accordingly with no order as to costs.
