What did the High Court hold?

The High Court held that the Tribunal was right in directing the ITO to allow the deduction of incentive bonus towards expenses for earning it. However, the deduction is limited to the extent of reimbursement of expenses actually incurred, capped at a maximum of 30% of the incentive bonus earned by the assessee. The question referred to the court is answered in the affirmative, favoring the assessee against the revenue. The reference is disposed of accordingly with no order as to costs. The specific quantum of 40% directed by the ITAT was modified to 30% of the actual expenses incurred, up to a maximum of 30% of the bonus.

What were the facts?

The Income Tax Appellate Tribunal (ITAT) referred a question to the High Court of Gujarat concerning the deductibility of incentive bonus towards expenses for earning it. The ITAT had directed the Income Tax Officer (ITO) to allow a deduction of 40% of the incentive bonus. The Commissioner of Income Tax (CIT) challenged this direction. The High Court had previously dealt with a similar question in ITR No. 54 of 1993 and other related matters.

What were the issues?

1. Whether the Appellate Tribunal is right in law and on facts in directing the ITO to allow deduction of 40% of incentive bonus towards expenses for earning the same? (Question of law and fact, concerning Section 37 of the Income-tax Act, 1961). Assessee's Contention: The judgment does not record specific contentions made by the assessee. The ITAT's direction to allow 40% deduction implies the assessee argued for such a deduction. Revenue's Contention: The Commissioner of Income Tax (Petitioner) challenged the ITAT's direction, implying an argument against allowing the deduction or at least against the quantum of 40%.

Which sections of the Income-tax Act were involved?

Section 37,Section 256(1)

ORAL JUDGEMENT

(Per R.K.Abichandani,J)

The Income-tax Appellate Tribunal has referredthe following question for the opinion of this Court under section 256(1) of the Income-tax Act, 1961. "Whether the Appellate Tribunal is right in law and on facts in directing the ITO to allow deduction of 40% of incentive bonus towards expenses for earning the same ?"

2.

Similar question had come up for consideration before this Court in ITR No.54 of 1993 with other cognate matters. For the reasons given in our judgment dated 27.4.1998,in the said group of matters, we hold that the Tribunal was right in directing the ITO to allow the deduction of incentive bonus towards expenses for earning the same, but only to the extent of reimbursement of expenses actually incurred upto the maximum limit of 30% of the incentive bonus earned by the assessee. The question is accordingly answered in the affirmative against the revenue and in favour of the assessee. The Reference stands disposed of accordingly with no order as to costs.
