HP PPS INDIA OPERATIONS PRIVATE LIMITED,BANGALORE vs. DEPUTY COMMISSIONER OF INCOME TAX, CIRCLE-3(1)(1), BANGALORE
What did the Tribunal hold?
The Tribunal noted that the issues raised in Ground Nos. 2 (disallowance of superannuation fund) and 3 (non-granting of foreign tax credit) had been rectified by the AO through a rectification order dated 15.12.2022. Consequently, the assessee's AR submitted that these grounds were not pressed. The Tribunal accordingly dismissed these two grounds as not pressed. Regarding Ground No.4, which pertains to the computation of interest under Section 234C, the assessee contended that it should be computed on the returned income. The Tribunal accepted this contention and directed the AO to recompute the interest under Section 234C as per the provisions of the Act on the returned income. Ground No.1 was considered general and not warranting separate adjudication, and Grounds 5 & 6 were consequential. The appeal was partly allowed.
What were the facts?

The case was selected for scrutiny, and due to international transactions, a reference was made to the TPO. The TPO made an adjustment of Rs.57,44,68,793. The AO passed a draft assessment order. The assessee filed objections before the DRP, which deleted the entire TP adjustment. However, in the final assessment order passed by the DCIT, Circle 3(1)(1), Bangalore, a disallowance of Rs.5,36,960 was made towards superannuation fund, and foreign tax credit of Rs.70,87,513 was not granted. The assessee appealed to the ITAT.

Whether the interest under Section 234C should be computed on the assessed income or the returned income (Ground No.4)? Assessee's contentions: Regarding Grounds 2 and 3, the assessee's AR submitted that these issues have been rectified by the AO vide a rectification order dated 15.12.2022 and therefore, these grounds can be dismissed as not pressed.
