C I T vs. YASHBIR SINGH
What did the High Court hold?
The High Court dismissed the revenue's appeal, stating that similar appeals filed by the revenue raising the same question of law had already been dismissed by the Court vide a judgment dated March 26, 2008, in ITA No.490 of 2007 and other connected matters. Consequently, the Court found that no substantial question of law survived for its consideration in the present appeal. The Court declined to entertain the appeal, deeming it without merit. The specific reasoning of the ITAT regarding the non-accrual of interest during pending litigation and its taxability only upon final determination is not elaborated upon by the High Court, as the appeal was disposed of based on prior judgments.
What were the facts?
The revenue, Commissioner of Income Tax-Faridabad, filed an appeal under Section 260A of the Income-tax Act, 1961, against an order dated March 29, 2007, passed by the Income-Tax Appellate Tribunal (ITAT), Delhi Bench 'I'. The appeal pertains to assessment year 2002-03 and concerns the respondent, Sh. Yashbir Singh, HUF. The core of the dispute revolves around the taxability of interest when litigation regarding its accrual was pending and had not attained finality. This appeal is one of several filed by the revenue on similar grounds.
What were the issues?
1. Whether, on the facts and circumstances of the case, the Hon'ble ITAT was right in holding that if litigation was pending before a Court and had not attained finality, interest would not accrue and could be subjected to tax only when it was finally determined? (Question of law turning on the interpretation of accrual of income and its taxability). Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The revenue argues that interest should be taxable when it accrues, irrespective of pending litigation. The judgment does not explicitly state the revenue's specific arguments or any authorities/precedents relied upon by the revenue in this particular appeal, but it refers to similar appeals filed by the revenue.
