What did the High Court hold?

The High Court held that in view of the order passed in ITA No. 362 of 2004, no substantial questions of law arose for consideration in the present appeal. Consequently, the appeal was dismissed. The reasoning for this decision is not elaborated in the provided text, other than the reference to the disposal of the connected appeal. Therefore, the specific findings on each of the five proposed questions of law, the reasoning leading to those findings, and the operative directions are not detailed. The judgment does not explicitly state any issue left undecided.

What were the facts?

The Revenue, Commissioner of Income Tax, Faridabad, filed an appeal under Section 260A of the Income Tax Act, 1961, against an order dated December 16, 2005, passed by the Income Tax Appellate Tribunal (ITAT), Delhi Bench 'D'. The appeal pertains to assessment year 1995-96. The ITAT's order was challenged for allegedly erring in deleting certain disallowances made by the Assessing Officer (AO). These disallowances related to foreign tour expenses of Mrs. Tapedar (wife of MD), foreign tour expenses of Sh. K.C. Tapedar (MD), commission paid to the Managing Director and Executives, personal use of a car, and salary of two retrenched employees. The High Court noted that this appeal was to be heard along with another appeal, ITA No. 362 of 2004, which had been decided by a separate order on the same date.

What were the issues?

The High Court was to decide the following substantial questions of law proposed by the Revenue: 1. Whether the ITAT erred in law by restricting the disallowance on account of foreign tour expenses of Mrs. Tapedar to Rs. 54,082/-, confirming the deletion of the remaining amount by the CIT(A), despite no evidence of business nexus. 2. Whether the ITAT erred in law by confirming the CIT(A)'s deletion of the AO's disallowance of Rs. 2,87,382/- concerning the foreign tour of Sh. K.C. Tapedar (MD). 3. Whether the ITAT erred in law by confirming the CIT(A)'s deletion of the AO's disallowance of Rs. 5,56,109/- on account of commission paid to the Managing Director and Executives. 4. Whether the ITAT erred in law by confirming the CIT(A)'s deletion of the AO's disallowance of Rs. 4,43,400/- for the personal use of a car. 5. Whether the ITAT erred in law by confirming the CIT(A)'s deletion of the AO's disallowance of Rs. 65,805/- on account of the salary of two retrenched employees. The Revenue contended that the ITAT had erred in law on all these points. The judgment does not record specific arguments from the assessee or mention any specific authorities, circulars, or precedents relied upon by either party.
