What did the High Court hold?

The High Court held that the appeal by the revenue was governed by the findings recorded in ITA No. 267 of 2008, which was an appeal concerning the same assessee for the assessment year 1997-98. The Tribunal had accepted the assessee's appeal for assessment year 1998-99 on the same reasoning as its order for assessment year 1997-98, which had been dismissed by the High Court. The learned counsel for the revenue did not dispute that the present appeal was governed by the findings in the prior appeal. Therefore, the High Court dismissed the revenue's appeal. The specific reasoning of the Tribunal for deleting the addition in the prior year is not detailed in this judgment, but it formed the basis for the deletion in the current year and the subsequent dismissal of the revenue's appeal.

What were the facts?

The assessee, M/s Mandeep Mushroom Ltd., engaged in mushroom and strawberry cultivation and sale, claimed the income as agricultural. For assessment year 1998-99, the assessee filed a return showing a loss of ₹6,14,961. The Assessing Officer (AO) made an addition of ₹2,39,315 to the trading account. The Commissioner of Income Tax (Appeals) upheld this addition. The Income Tax Appellate Tribunal (Tribunal), following its earlier order for assessment year 1997-98 in the assessee's own case, deleted the addition. The revenue, Commissioner of Income Tax, Faridabad, has appealed this order of the Tribunal to the High Court.

What were the issues?

1. Whether, on the facts and circumstances of the case, the order of the Hon'ble ITAT is not perverse in deleting the addition of ₹2,39,315/- made by the Assessing Officer in the trading account, when the Assessing Officer had clearly pointed out various discrepancies on the basis of enquiries made and as discussed in the assessment order? (Question of law/mixed law and fact, turning on the AO's findings and the Tribunal's deletion). Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The revenue argued that the Tribunal's order deleting the addition was perverse, given the discrepancies noted by the AO based on enquiries. The revenue sought to establish that the Tribunal's decision was not based on sound reasoning in light of the evidence presented by the AO.

Which sections of the Income-tax Act were involved?

Section 260A,Section 143(1)(a)
